Have a nice trip MrP.

Decent last hour recovery for my lot, particularly my REITs- ended up 0.3142% investing not a piece of cake but easy as pi for me today. MEGP biggest gainer, no real losers. Bought some ASLI - its a windup situation that I am hoping will return 20% over the next 12-18months. Not a particularly exciting purchase.

A decent week - YTD +9.62%

Very pleased with +1.24% this week taking my YTD to +6.40% and a new all time high, even allowing for the monthly contributions!

That's me done for a week as we're off to Holland (sorry, The Netherlands) on Sunday so we'll have to listen to the tennis on Radio 5 Live and hope to catch the football on tv at our overnight stop in Belgium.

Also, for a contract to be legal there has to be a consideration. Without notifying wllm of the cost he has to pay, and with wllm believing he was paying nothing, then there is an argument that there is no contract to enforce - so was the cost clear in the contract he signed or was he deliberately misled as to any cost by them hiding it in some way?

30 sec search shows that a premium SUV should be about £75 per day. So £309 is price gouging. I don't know if you are clocking up a high mileage but if I was the insurance company I wouldn't cover that. I'm surprised that Aviva recommended this lot - if it does go to court I guess someone is going to have to justify that cost. Hopefully not you Wllm. Sounds like a horrible mess to be stuck in.

Looks like a down day for me, but nothing too significant.

wllm! It's Aviva again. There might be a precedent here for you. You thought you were getting a courtesy car from Aviva just like this guy, I'd say.



Deputy District Judge Printer, sitting at Portsmouth, said the otherwise legitimate claimant in McNally v Aviva Insurance Limited had been hoodwinked into believing he was speaking to his insurer and arranging free car hire......

... The judge ruled the credit hire agreement for an estimated £27,000 was ‘wholly unenforceable’ and did not represent any form of contingent liability to McNally.

Basically, the Solicitors and the car hire company are Sister companies, they share the same Directors, I'm a bit wary of mentioning them Dr B as they are telling me that as long as I comply with their requests for any information they ask for and I haven't misled them in any way then they won't come after me for the costs. It looks likely the AMC will take the other sides insurers to court, but, get this, the court action is in my name and I may have to attend unless there is a settlement. If I refuse to attend or take part in the legal proceedings I breach the hire agreement I signed. It was a relatively minor accident which has dragged on for almost a year. No wonder our Insurance premiums are going up.

Just got back from the Stag having it's annual MOT. At 50 years old it doesn't need one but I like to keep it up and get everything thoroughly checked out. Passed with flying colours and no advisories.

My lot looking subdued today, but it's been a good week.

I think all pollinators have been low in count here this year due to the cold, wet weather and birds seem pretty keen on crumbs we put out. Lots of midges at times, though. (Will there be a plague in Scotland?) I noticed that blackberries are colouring early, which seems very odd with the very low sunshine levels. We look like we're going to have a whopping Bramley crop if No.3 will stop kicking them out of the tree with his football.

wllm, that's outrageous. They should not get away with that . Write to your MP and copy them in.

Overcast and cooler here this morning.

Quiz = 1/7 and that was a guess :-)

'Big Butterfly Count' starts today and goes on for a few weeks. Must admint there's been a dearth of the little fellows around here this year. I think I've seen just three this week. Same for bees and wasps . Worrying.

wllm, another simple method you might try would be to get a few friends to email in saying how appalled they are at how you've been treated and that they will be sure to recommend to everyone they know to avoid Aviva. I think that would really make them think about what they are doing - not just in your case but for all future cases.

How many here have AV. shares? It could be interesting for them to think it might pop up as a question at the next AGM.

That's awful, wllm. How can Aviva not be liable if you have built up costs they referred you to when they did not provide a replacement car as contracted? I'd expect a solicitors letter and threats of bad publicity might see them start arguing between themselves and drop you out? I'll be sure to tell people to avoid Aviva. Let us know how you go on. Don't forget to threaten BBC's Watchdog as an option when you write to them.

Are you able to share the names of the CMA/Car hire company? There is also Kate Morley at the telegraph and the guardian have a similar column. I think they all like you to take it as far as you can beforehand though.

thanks gents will try going to Aviva but I suspect they will say they have washed their hands of the claim. I'm kicking myself for not reading the hire car agreement, but, as I had a courtesy car as part of my insurance policy it never occurred to me I could be liable for the costs, or, that the costs would be so high. You live and learn as the saying goes.

It's been a good week on the markets so far, hopefully, that continues tomorrow.

When I was involved in my car accident last year I contacted my Insurer, Aviva, they referred me on to an Accident Management Company as I was not at fault. The AMC arranged a hire car, I mistakingly thought this was through Aviva as I had a replacement hire car as part of my insurance, it wasn't, it was a Credit Hire car. I was initially given a KIA Sportage and this was then changed a few days later by the Hire company to a Volvo XC60 the cost of which I dicovered later was £309 per day. I had the car from beginning Sept to 10th Nov. Total cost approx £22k. As the at fault drivers insurance company are refusing to pay these exhorbitant costs, the hire company are advising they may have to pursue me for the hire car costs, what a scam.

I'm really disappointed in Aviva as they never made it clear to me that using an AMC may leave me significantly out of pocket.

Good result for England and well deserved although it was never a penalty.

I've been to watch my grandson in his year 6 end of school rendition of the Wizard of Oz - its frightening how quickly they grow up - he took great delight in telling me that his shoe size is now the same as mine - he is 11 next month.
