Judge sets deadline for e-cig makers to apply for FDA approval

A Maryland district court judge has set a deadline of May 12, 2020 for e-cigarette makers to file marketing applications with the FDA in order to keep their products on the U.S. market. The deadline is consistent with the agency's June proposal for a 10-month window.

While we expect some continued top-line and margin momentum, our growth outlook is tempered by softer US expectations, and we now see relatively little upside to current valuation. iQOS and JUUL remain the most proven reduced risk platforms, and BAT continues to compete against both. US retail sales trends give us greater cause for concern as declines have accelerated, even ahead of the upcoming US iQOS launch. We lower our US growth expectations but increase our 2019E EPS from 310.0p to 316.5p and 2020E EPS from 328.5p to 338.0p, as better currency more than offsets our cut to underlying earnings. We lower our price target from £33 to £31 and downgrade our rating to Neutral.

Competing with JUUL, iQOS in the US looks daunting. iQOS and JUUL stand out as the two reduced risk products with the most significant traction with consumers, with JUUL reaching $4B in annualized US retail sales and iQOS posting over $7B of revenues in 2018. iQOS is now set to launch in the US, where BAT's cigarette declines are already accelerating. The US is BAT's highest margin segment, and its highest margin US brands appear to have the most acute market share pressure (Natural American Spirit retail sales fell in the latest 4 week period - a first). JUUL is making a push outside the US, though nicotine level restrictions may limit its growth in many markets abroad.

Currency adds upside to our estimates, but fundamental outlook softer. We lower our EPS outlook on a softer US outlook by 3.5p in 2019 and 5.0p in 2020, which is more than offset by favorable currency of 10.0p in 2019 and 14.0p in 2020. Brexit uncertainty may add a further currency lift to EPS (especially in a hard Brexit scenario), but our focus is on underlying fundamentals, where risks appear to be growing, especially in the US, as BAT's US trends erode at a faster pace than we had expected (charts inside).

hmmm re the toxic chemicals 'story'

It is not about the level of the element but whether it is mobile and can enter the liquid itself in a form that is harmful to life. Cd in the label - yes, that is because they were probably testing a bright red label and many high quality red pigments contain Cd. The Cd-containing pigments also tend to be insoluble, Nothing to see there.

Next, Pb. Many low melting point and coloured bottles will contain 'toxic elements'. However, they are immobilised in the glass matrix, where they provide a colour centre. Same with Cd, which can be used to colour bottles red. Some of the more funky colours use chromium (Cr) and uranium compounds (U - depeleted of course).

One of the ways to immobilise nuclear waste is to encase it in a glass matrix. Why? the matrix is pretty resistant to water, temperature and time thus locking away the nasty stuff in a non-powder form that limits toxicity to the general public.

I would be more worried about the effects of natural uranium in rocks and the production of radon than any of this stuff.

As a further example, take common salt - NaCl. Test it and you find it is 50 at% sodium and 50 at% chlorine. Looking at the materials safety data sheets for sodium and chlorine suggest this stuff would be highly toxic to life. Sodium will react violently with water, producing hydrogen that can then spontaneously combust. Chlorine is a toxic yellow gas. Breathing it leads to pulmonary irritation and serious damage to the respiratory tract. However, when the two are combined into a single compound you get NaCl, common salt, which we eat every day, and are happy to hold in our hands.

Summary, take all these stories about toxicity with a pinch of salt (pun intended) unless you understand the chemistry.

and yes i have a degree and then some in chemistry so i have some idea what i am talking about. I also spent several years making pigments for possible uses in the cosmetics industry and car industry. You know, those multi-coloured pigments depending on the angle of light reflecting off the surfaces. Oh the interesting elements they contain! ;-)

Turner wrote in the study that cadmium, lead, and chromium was found in bottles, but at small concentrations and health risks were considered to be low.

He said enamels contained the most toxicity, with cadmium concentrations of 20,000 parts per million (ppm) in the label of bottles, and lead concentrations of 80,000 ppm in wine bottles.

Not sure if that is true. It's perfectly possible to drink moderately without affecting your health (unlike smoking), and the impacts of 'passive drinking' are also much lower than passive smoking.

Japan about 20 years behind the rest of the world on the banning smoking in offices front. I recall when it first came in - much time wasted get in lift, going downstairs,smoke n chat, then lift back up.

Productivity must've collapsed.

The USA has realized that vaping is just another way of getting kids and others addicted to nicotine

Tar like residues from this sticks to the inside lining of your lungs



Children's lungs are still growing and in development, the use of such products is going to cause impaired lung development and function as well as cancer and cardio issues.

buywell thinks investing in companies that design and make such products is unethical.

buywell hopes another USA city will follow San Francisco's lead within a month, a city that sees children as it's future.

That's good news, e-cigs being more expensive will make it less convenient for people to switch from traditional cigarettes where IMB and BATS make most of their profits. Biggest losers in this will be pure play vape brands like Juul.

Why for example are such vaping flavors named like bubblegum, caramel, peardrops, cola cubes etc

Vape products that 50% of schoolkids in the USA are getting hooked on

I personally find the whole thing regarding schoolkids as very upsetting. As well as a public health problem from breathing in the exhaled vape by these walking steam engines.

The FDA will have to act soon after San Francisco bans e-cigs

Vaping is steadily being regulated across the US.
Some state and regional governments in the US had extended their indoor smoking bans to include e-cigarettes.

As of April 2017, 12 US states and 615 localities had prohibited the use of e-cigarettes in venues in which traditional cigarette smoking was prohibited.

High schools and some middle schools throughout the US have been revising their tobacco rules to ban vaping on school grounds.

A review of regulations in 40 US states found that how a law defines e-cigarettes is critical, with some definitions allowing e-cigarettes to avoid smoke-free laws, taxation, and restrictions on sales and marketing.

The tobacco industry heavily lobbies states to make it harder to regulate and tax e-cigarettes.

Clearly much more needs to be done ... congrats to San Francisco

Shame on all the rest

Last year there was a 78% increase in the use of e-cigarettes by USA secondary school students but the FDA still do nothing as more and more kids get hooked on the nicotine high.
