As predicted on this thread TOM did not have the cash to purchase the 10% deposit and sufficient operating capital.

So the third party was the party that caused the cash flow problem in the first place. The terms of the loan will be very important in terms of raising the finance and shareholders are advised that the NOMAD believes that they are fair. Here is the wording:

"consider that the terms of the Loan are fair and reasonable insofar as the Company's shareholders are concerned."

The loan arrangement is probably better than a placing, but shareholders need to be aware of the lenders rights in the event of a default on the loan.

Shareholders also need to understand why a sub lease of 320 acres has been created, and the terms of that sub lease.

Anyway that is the easy bit out of the way.....................

Tomco are always conservative in their reporting, we are all very much aware of that by now. They actually report as all companies should, pointing out POTENTIAL negatives were there are any.

With regards to the well drilling campaign, the Site Reserves Report will have identified the likely presence of oil at the deeper levels being looked at (below 600ft). They plan to use technology that has worked elsewhere before for the recovery of the oil identified, BUT until the technology is actually installed and extracting the oil it is always considered as non-certain. The pilot wells in December will (if successful), change it from non-certain to certain.
