Unless there is an agreement at the hearing the date of handing out will not be determined at the hearing as one can not know how long does it take to prepare the final paper. All imho

I should expect an rns on Fri or Mon saying the hearing has taken place and the decision is expected within a certain timeframe, unless of course there has been a decision made there and then.

Having studied the objection at length and the various other aspects of the law, this one should be like shelling peas for the hearing examiner.

It's one pensioner who doesn't understand the law with a load 'facts' which can be proven not to be facts with ease v an ex water court judge.

Even if they were facts, I'm not sure they are relevant.

SG, whats interesting here, is that we know the timescales for all parts of the process, eg 2 months public notice, additions of 7 days for postal issues, 30 days to respond to x,y,z etc, which has enabled you to pinpoint accurately when expected updates should be forthcoming. The problem here is that we dont know the amount of time the examiner has to reach a decision and process the decision according to regulatory guidelines. Im thinking end feb or mid march.

I'm not sure if a hearing allows public access, if it does then it will be a lot warmer in there than out here. Struggling to sleep with all the jet lag and that.

SG not in Montana, much as I would like to be. My reasoning is that it is a public meeting and IOF or others will be able to give unofficial feedback after the end of the meeting (or could even leave early once the direction of the meeting appears clear). Either way something likely to leak Thurs after hours imo.

Feedback? are you in Montana this week. A 9am Start would be 4pm for us. 5pm finish midnight here.

Trip back to Colorado if it's down and dusted on the day.

It could take many weeks to get a result. I would suggest not as I can't see anything too difficult in the objection and he can't introduce new parts.

As I said the more I look the more I think the sells this morning are to do with a QFI forced seller.

That aside TA folk/traders etc would sell. If you recall Zac said the main resistance is at 44p so you will get TA sellers under that. They haven't the slightest interest in news.

If we get good news and it breaks out, it's just another trading channel to them, all they want is volume.

technically,
all the trades on adv are buys or neutral (the AT trades being a buyer and seller transaction at the given price point so I treat them as neutral).

Never mind the 1 trade yesterday, what about the hundreds of sells this AM. Very strange when we are about to get the water permit. We should also get the review soon. Productivity is on the up, and the chemical plant is going on in leaps and bounds.

Re sellers.

Part of my reason for being patient re the price drop was all to do with other shares.
I know from exchanges here and on other IOF threads that shares like NCT, QFI and mosman all had a number of folks here buying at higher prices. Assuming some were geared and exposed, there is always a knock on effect in their portfolios.

Personally I took the IOF sells this morning to be someone forced to sell due to recent QFI moves. Could be wrong but that's the way I see it.

There was a supply and it was a case of trying to work out who and watch for when the supply looked like drying up.

Re the hearing, it could be many weeks before a result is known. Logically and looking at the 'facts' the HE will probably know which was it's going very swiftly. It all depends how long it takes him to document his decision.

He already knows what the points raised will be and there is nothing complicated about it.

If Carlisle were to win on his 'plenty of water available' point from depots. Then in theory all future permits in the area shouldn't be awarded, including irrigation and they must all be forced to buy water from Carlisle, until his allocation is used up. They they can apply for one.

That's more or less his argument.

I suspect he will turn up but in theory based on the facts, his points should crash and burn very quickly. His point about affecting his business and permit is entirely true, BUT, not valid.

I would imagine he will try to go on about such points but find he will be cut dead by the hearing examiner.

The only points he can raise are about beneficial use. In relation to his points raised in his objection, many of them are not facts and in some cases deliberate misrepresentation. Obviously deliberate as he records different facts in his own application.

Given the excellent research superg1 has done on the likely outcome of the hearing tomorrow, whether the plaintiff turns up or not, it is quite amazing that some 65k '0' sell trades have taken place already this morning!

I had been thinking the same thing as bocker, namely that there is a good chance that the objector will pull out at the last minute if his case is really hopeless. Or he may reach an 'out of court agreement' with Iofina to drop his case.NAI
