San Francisco officials look to ban e-cigarettes

Altria (MO -1.9%) is lower after officials in San Francisco proposed legislation to ban the sale of e-cigarettes in the city.

The proposed bill also seeks to bar companies like Juul (JUUL) from occupying property owned by the city.

"We don’t want them in our city," Supervisor Shamann Walton says of e-cigarette sellers.

FDA remaining hardline and Congress to get involved...

US Food and Drug Administration named National Cancer Institute director Ned Sharpless as acting commissioner to replace Scott Gottlieb

investors were premature to assume that Gottlieb’s departure would lead to a lighter regulatory hand over the tobacco industry

Market report:

On the upside, tobacco stocks made gains for the second day in a row as investors welcomed the resignation of America's chief drug and tobacco regulator, Scott Gottlieb, who had been spearheading a ban on menthol cigarettes and curbs on e-cigarettes.

Analysts at RBC Capital Markets said: "While this event serves as a near-term catalyst, the real impact depends on who ultimately replaces him, in our view. We are monitoring the situation closely with our contacts on the Hill but understand that the process to permanently fill the position is likely to be lengthy.

"Commissioner Gottlieb’s departure could be viewed as an opportunity for aggressive actions against the tobacco industry to be reversed and tobacco regulation to be moved to the backburner, as his proposals had run into fierce opposition by anti-regulation groups."

Barclays:
"...BAT’s stock was trading at GBP35 before the menthol ban announcement, IMB at GBP27 and MO at 65. Trading at 9x 2019E P/E for BAT and IMB, and 12x for MO, the stocks can easily see a 20% bounce from here, in our view...."

If any fallout here Monday morning because of the BATS ruling may be a good buying opportunity here as IMB not tied up in that case.

Quebec's Court of Appeal has upheld a Quebec Superior Court ruling in two class-action lawsuits against tobacco companies awarding billions of dollars in damages to 100,000 people.

In the 422-page ruling, the court said that the Superior Court's decision was correct, except for some small technicalities.

The adjustment in damages amounts to about $2 million of the approximate $15 billion the companies were ordered to pay, the prosecution said Friday.

In a statement Rothmans, Benson & Hedges Inc. confirmed it will seek leave to appeal the ruling with the Supreme Court of Canada.

A lawyer representing Imperial Tobacco Canada said the company will review the ruling before considering its next steps, which may include an appeal to the Supreme Court.

JTI-Macdonald Corp. is also considering taking the case to the Supreme Court.

++ Imperial Tobacco Canada has no relationship to Imperial Tobacco Group plc. Imperial Tobacco Canada is the Canadian subsidiary of British American Tobacco.

@Eeza - 'yeah but no but...' yesterday it was +82.5p/+3.14% for nothing obvious (to me!) except perhaps some sector rotation.
Re: yr numbers today 100-say 65.5 = a -34.5p move above/beyond the div. Divide that by last night's close of 2713.5 = -1.3%.
I don't see a pattern, is such volatility common around IMB's XD? ...

For those of us who re-invest our divs via the DRIP plan it would be nice if the purchase of these shares was carried out on the XD date. Usually they seem to be bought on the most expensive day prior to payout. Still it does leave more for dear Alison. Grossly over paid judging by the price performance over the last 18 months.
