If Baghdad want to be part of the new ITP agreement then they'll have to negotiate a tripartite agreement with the other two parties. Turkey will be free of any legal shenanigans from Baghdad and will want the pipeline to be in operation and generating revenue, and the Kurds have the legal right to export the oil without interference from Baghdad, so if Baghdad want to be part of the new deal then they'll have to negotiate. Baghdad sure as hell won't be exporting through Kurdistan and on to Ceyhan if the Kurds can't export either that's for sure. | habshan | |

The result of that is that as Sudani correctly said, the PSCs cannot be revoked, which is why they haven't tried to revoke them and are having to negotiate. And as Caggins confirmed - "We do stand firm, our contracts are valid and recognised by the London Courts of Arbitration, these contracts have been tested in lawsuits." The contracts are legal because under the Constitution the Kurds have the right to sign their own contracts, and they can sign their own contracts because the Constitution confers on them the right to manage their own oil & gas affairs. And as Sudani correctly says, the courts have ruled that that is the case. What that means is that next September when the ITP agreement expires the Kurds can use their constitutional right to do their own deal with Turkey and Baghdad will have no right whatsoever to interfere, and Maliki's clause giving Baghdad the ability to stop Kurdish oil being exported from Ceyhan will expire as well. They have a legal right to sell their own oil how and to whoever they choose. They have a legal right to develop their oil & gas resources, sell what they produce and receive the money themselves and that will enable them to become financially independent from Baghdad. The Kirkuk to Fishkabour section of the ITP goes through Kurdistan and if Baghdad are to secure it's use for BP they will need permission from the KRG. So who's in control Sarah, it sure as hell isn't Baghdad, it's hardly surprising that Baghdad are currently so keen to cut a deal while the Kurds and APIKUR seem so laid back, it's Baghdad who are doing all the running.
