04/11/2009 13:25 | More comments on the digital spy forums, people already thinking about how the Cellcast channels will almost certainly be able to stay on Freeview with a few small changes: "They (the slapper channel provders) may get round this by hiding behind an MHEG screen a-la TVX. I'm sure that creating an additional premium rate number to call to unlock the screen would be quite attractive to them. Knowing how the NuLab quango regulators are oft happy to roll over in favour of big organisations instead of protecting the public/consumer interest (particularly if there are taxes to be had), then I can see a watered down version such as above happening." | ![]() the analyst | |

The consultation period ends on January 15th, then there will be a long delay before coming up with a final decision (another year?), then after that the channels will have 6 months or so to bring it all into effect. In the meantime, we can take all that freeview money and build the cash position. Also in the meantime, Freesat will grow and grow. Also in the meantime, new ways for the Freeview channels to comply with the regulation will be developed (just needs a simple way to segregate them from non-adult content) rns coming? | stefanos2 | |

Ofcon reckons the channels need to be labelled as a group as well as being capable of being excluded from an EPG by user choice. They state that although there is a separate Freeview category from LCN93-99 for these channels, that alone would not meet the proposed new regulations. What is needed is a new EPG and/or platform that is capable of segregating channels. Not only that but a receiver base that supports it. Maybe a substantial penetration (ouch) of households owning such a device? Therefore slapper & psychic channels are unlikely to be on Freeview in the near future. I suspect the regulations were designed to achieve the cleaning up of Freeview, and were not made to protect the public whatever Ofcon says the reason was.
