23/8/2009 19:52 | Loverat, I know the company was never registered as a charity. It has charitable objects but s.652 bites regardless of that. The CC guidance notes do however explain s. 652 in simple terms. Companies House is now quite pro-active in prompt action for non-compliance. I'll stop there as this is not an area of recent expertise on my part ...not often you will hear such a confession on a free bulletin board! | korner | |

Unless you are saying that this was due to some failure to comply with Company House procedures - i.e not producing accounts etc - there are plenty of companies registered which have not filed accounts. A bold and noble idea set up by four investors (albeit some of whom had never heard of each other) in a blaze of publicity. The Investors Support Fund was even mentioned in the recent Smith V ADVFN court case and seems the founding member said that statements made against him on the LGB thread would have a detrimental effect on the reputation of the subsequent charity when it was registered. Not sure whether a High Court Judge would have gone along with that notion but the whole issue of the charity and subsequent goings on may well still be relevant to that case. | ![]() loverat | |

22/8/2009 17:44 | Thanks to all the people who have provided information and support so far. As I say, we are ready for the first stage. The first stage is intended to deal with the 'numpties' in all of this. These are the people who have posted carelessly on here in the past. Nevertheless, these so called 'numpties' are the ones who have declared themselves whiter than white and no doubt the authorities and press will be more than eager to go after these people. Because of a recent development I have now included evidence regarding one person I previously said I would not refer. So there are now three people in total. There is one reader of this thread from abroad who I believe may have information to help us with going forward with the second stage (and perhaps more serious part) of the proceedings.
