The answer is that you cannot get an all encompassing composition of matter patent on a naturally occurring molecule, but it is perfectly possible to obtain a usage patent, as Synairgen have exemplified with WO2011110861, which appears to be filed (and granted) in a numerous markets.

I think there was a question earlier about Synairgen's IP on inhaled Interferon beta

As far as I can ascertain the main application covering the technology is contained within this PCT application (WO2011110861)



The priority date is 2010, so patent expiry in most jurisdictions should be in 2030 or thereabouts
