Look at the last update they haven't yet confirmed it was going ahead on the 19th, but we know it took place. As both applications are within the defined service area listed by The water bureau, then neither of those applications under the points raised by Carlisle can be awarded if he was successful. In fact in theory no permits should be awarded in the 12 counties they have listed until all water is being used up at existing depots. In reality that would mean longs queues of trucks and truck rage wars, with customers not receiving a prompt and reliable service. The same goes for irrigation permits, Carlisle has about 8 of those and if he isn't using all the water, then no one should get a permit for that either as they can buy it from him. Taking it to the extreme (but relevant). There is plenty of wheat about so why should permits be awarded to irrigate wheat. To do so may cause Carlisle to have competition for his own wheat sales. It's a completely barmy contested case, but disruptive, and Carlisle wanted that. It's his only chance to save his water business, so why not give it a go. | ![]() superg1 | |

There is not point in issuing a RNS until they have the permit certificate in their hands and that could be a month or so after march 6th. 22/2/2015 20:45 | Just to clarify It's wildcat and Denbury onshore that have applications in. Under the terms Carlisle claims no one else is allowed to have a permit until all his water is bought up. That's just about all of what his objection is about. The service area point is null and void as demonstrated. His number of permits is incorrect, his volume use per well is incorrect, and his claims that they LOIs by IOF are not real is also incorrect. It would be total madness for him to succeed. The HE will have been hit by masses of info that tore Carlisle's objection apart. The HE has no need to write it all up he can get IOF to do that in a closing brief and just use that in his final order. HEs rely on those present to provide the evidence for him to make a final order he won't go looking for it. The only thing we don't know is the general feel at the hearing. IOF may well comment on that in an rns. I think it's likely they will release one early this week, working on logic. | ![]() superg1 | |

22/2/2015 19:35 | 7cats No decision has been made neither party has yet completed their closing brief a decision will come post 6th March. We are no further on other than opening briefs with cross examination complete. Yes IOF could appeal and I would as I can't see how they can possibly fail legally. 2 more apps are already in for the area, so both of those will have to be rejected if IOF were turned down. US water laws are about citizens having a right to water, so it starts off in favour of the applicant if they can show a need. As Bob shaver said in a strongly contested case in ND, if the applicant meets the criteria and the water is legally available, then by law they have to award the permit. That case made the news and the permit was awarded. In IOFs case, all criteria are met. Legally available, physically available, no adverse effect and adequate diversion are all proven are not part of the case. 3 tried the legally available and all were rejected. That was easy as it was simple maths I stated clearly that those criteria could not be deemed as valid objections due to it being the Missouri. All that was left was beneficial use. Carlisle included many errors or intentional lies and those would have come out in great detail on the hearing. | ![]() superg1 | |
