24/11/2014 06:48 | After two weeks, the final submissions were heard today at the Magistrates court in the trial looking at the welding works that lead to the 2011 port explosion, which resulted in the death of a 40-year-old man. ‘Nature Port Reception Facilities’ face nine charges of breaches of health and safety legislation. It follows an investigation by the Gibraltar government’s Factories Inspector, John Moreno. “My submission on the facts is these works were not commissioned by Nature.” This according to John Restano QC, Nature’s lawyer, whose closing statement lasted around three hours. Mr Restano highlighted that Plant Supervisor, Edward Gracia, had previously disallowed similar works at the water treatment plant and he would’ve done the same if he saw this work had been commissioned. Mr Restano defended Nature’s Health and Safety regulations. He reminded Stipendiary Magistrate, Charles Pitto, of witness evidence previously heard by Mr Gracia, who said Nature’s “health and safety record keeping was all generally good.” In respect of whether Nature had an effective safety management system, he highlited the evidence provided by an industry expert appearing for Nature, Professor Booth’s comments that Nature’s systems were “generally good to excellent.” Appearing on behalf of the prosecution, Mark Zammitt, gave a shorter closing statement in which he reiterated the main facts of the case. Mr Zammitt focused on the work carried out by the employees and whether there was a requirement for a written risk assessment; he argued there was a requirement, which hadn’t been met by Nature. The company contests this. All evidence in the trial has now been heard. Stipendiary Magistrate Charles Pitto has adjourned the case until next Friday when he will deliever a verdict. | condom2 | |

Hardly high convictions. Perhaps the crux with this company is whether: # Their Compact Treatment Units are really penetrating the market after several years of trying, and # Their two would-be cash cows (Gibraltar and Rotterdam Port services) can start delivering again. Until then, free cash flow generation is slim and the company is reasonably valued at £15m. It's easy to let the allure of "global port services" mask the reality. | moathunter | |
