Clearly he was again advised (wrongly) by his lawyers and one could take the cynical view that if they again advised him wrongly on the dates, how can we be certain that they haven't made other wrong decisions with the tribunal. Somewhat bizarre for someone to cite Metal-Tech given Metal-Tech didn't pass the jurisdiction stage due to bribery & corruption issues (breaching Uzbek law and the BIT) and OXS advanced. If anyone thinks that White & Case wouldn't have gone to great lengths to find something along these lines that would have got OXS 'knocked out' in the jurisdiction stage then they are deluding themselves. Of course the length of time taken means it is a complex case on either merits or, more likely in my view, quantum. Undoubtedly Yukos precedents will have had to be taken into account and I suspect Ms Sterne has dissented on something or other. Clearly, however, there has been no knock out blow with any bribery and corruption issues. Calunius will have done their thorough due diligence on this as well. | ![]() nick2412 | |
