06/2/2019 21:24 | BACKSTOP ILLEGAL UNDER EU LAW It’s not just the legality of the backstop under UK law and the Good Friday Agreement that is being challenged, now a leading legal firm has said that the backstop is also illegal under EU law. HerbertSmithFreehill “on the basis of the EU’s own view of what is legally allowed under Article 50 and on the basis of which the negotiations proceeded, the backstop in its present form is illegal as a matter of EU law. The Attorney-General of the UK came to a similar conclusion in paragraph 17 of his advice to the government of 13 November 2018. It could also be argued that the backstop is inconsistent with the aim of the Treaty on the European Union to promote peace (expressed in its Article 3) since it is inconsistent with the institutional provisions of the Belfast/Good Friday Agreement and therefore undermines it.” There is also a formalised legal procedure in the EU for ensuring the legality of an envisaged international agreement set out under Article 218(11) of the TFEU, which could force the ECJ to give a ruling before 29th March. Last week, aiming to buy herself time and stop Parliament from taking over the Brexit process, Prime Minister Theresa May had promised that, if she didn’t have a fresh deal by Feb. 13, she would make a statement that day and lay a motion that they could vote on the next day, giving them another chance to call for an extension of negotiations. The official said both that a deal was unlikely to be agreed in the next week, and that the vote could take place later. 06/2/2019 20:01 | Bob, our politicians could be similarly offensive to Brussels for being obstructive and failing to reach an agreement. All they can say is that the WA is not for negotiation - or haven't you been listening? We can only plan so far, the rest is up to negotiation - and that requires flexibility from both sides. That said, it's quite clear from the UK that we wish to leave the club, and would like to do so with what should have been a very easy trade deal. Unfortunately, the EU has said that they will make us suffer - not my words, but theirs! So, if you as a Scot who wishes for Independence, and I sincerely hope that you get it and achieve a good trade deal with the rest of the Union, want to support Tusk, I'd like all to know that you don't speak for the rest of us South of the border. | ![]() poikka | |
