The flaws in the Withdrawal Agreement fail any forthcoming UK-EU futureNovember 04, 2020By Jayne AdyeTHE BREXIT NEGOTIATIONS with the EU are drawing to a close, but it's clear the flaws in the Withdrawal Agreement fantastically fail future generations – and the public who voted to Leave in the EU Referendum. There may be some movement on one of the most contentious issues – fishing – and we may end up with a Trade Deal of sorts – if one has not been agreed behind the scenes already. I can't tell you exactly what it will contain as after all, the Government has kept us all totally in the dark with the details. What I do know is – with or without a Deal in place – the Withdrawal Agreement ensures the United Kingdom's relationship with the European Union will look nothing like Canada's or Australia's! The Withdrawal Agreement signs the UK up to several sovereignty-defeating clauses, such as:  Cooperating in – and financing – some EU projects, like Horizon 2020 and the European Atomic Energy Community;Maintains our liability to finance EU investments to the tune of billions of pounds through the European Investment Bank – for years to come;Shared jurisdiction of State Aid;And, a backdoor for the European Court of Justice.These are all things the Withdrawal Agreement signs us up to – and they all go much further than a normal Free Trade Agreement should.This means that even if the talks collapse at the last minute – a bare-bones 'Australia-style' Deal, or 'a trading on World Trade Organization terms-style' Deal is absolutely off the table. Even if a Deal full of compromises is secured, I fear the problems within the Withdrawal Agreement may become exacerbated – so we should forget about a 'Canadian-style' Deal as well!The truth is, the Government – and particularly the Prime Minister and the Chancellor of the Duchy of Lancaster, Michael Gove, have largely ignored thecontinuous calls and warnings from profound voices inside and outside of Parliament challenging them (including myself quite a few times here and here). The Withdrawal Agreement rules out the Brexit we were promised. It does not allow us to 'Take Back Control' as we were promised when Leave won in the EU Referendum in 2016.If the occupants of Downing Street don't listen, they will soon find out this new relationship with the EU is certainly not a good one. Millions of Brexit voters who voted the Conservatives in with a thumping majority at the last General Election, will feel betrayed and will not forget it at the ballot box next time.The Government's laissez-faire attitude to making any changes to the Withdrawal Agreement is shockingly similar to 2019. Its failure to acknowledge and resolve the issues gives me flash-backs of Theresa May – who Ipersonally challenged about the problems in her original version of theWithdrawal Agreement when I met her in February 2019. Then, Mrs May denied any problems even existed – and I had to actually ask her if she had ever read the document herself!With limited time left, and the need to Leave the political institutions of the EU, Boris Johnson may have managed to get some limited improvements over the line. However, the EU never had any interest in changing the major details of an agreement which simply gave them what they wanted.Overall, the major aspects of the Withdrawal Agreement remain unchanged and a legal web of continued control over the UK has been put in place.This is already producing very serious problems. The European Commission is already trying to interfere and oversee the proposed UK merger between Virgin Media and O2. This would create thousands of jobs in the UK and would only affect UK customers, yet the European Commission is seeking to undermine the UK's Competition and Markets Authority – and is permitted to do so under the Withdrawal Agreement. This kind of interference will continue far beyond the Transition Period.The EU clearly knows there is growing public discontent with the Withdrawal Agreement in the UK, so I think they played along with Number 10's brinkmanship throughout October ending with a very brief walk-out from the negotiations two weeks' ago. We still don't know what is going on. Various EU Leaders have made recent statements, but none of them are consistent, and so far we have heard absolutely nothing from either Boris or Lord Frost. For some ridiculous reason they have all been working in the COVID-19 hotspot of Brussels, supposedly returning to London to continue the negotiations this week. What a waste of time and money!The European Union has always been determined to tie us into an 'EU-style Deal' and so far, we have not been canny enough to outmanoeuvre them. There is a window of opportunity for the Prime Minister now, but he had better get a move on with less than 8 weeks to go! He must begin to listen to theclear concerns ofthe Great British Public. We must continue to keep up the fight to Get Britain Out of the Transition Period with the Withdrawal Agreement repudiated – before it's too late.

Grahamite2, it's a decision. It's not totalitarianism. Maybe the wrong decision, but no one has much idea right now - not even the Germans! It will get better, though. Patience, though I have great sympathy for becalmed businesses.

Why do the Electoral commission, the the Law Commission, the equalities commission etc seek to wish to impose their controls on all?
Is it just the beginning - no - all u smart TV owners, smart phones are already caught.
Why were ID cards such an invasion of privacy?
They might prevent voter fraud which is rife in the postal votes scenario.

whats the point of the law if law enforcement without the tools to enforce it.

Seems the next step is mandatory monitoring of homes for such crimes. Prehaps the echo dot, although smart phones, laptops and some smart tv's all have microphones.

Not withstanding, secret microphones that could be placed in the homes of those you want to remove.

But, on another note, I hope some of the Trump acolytes will reflect on his (Trump's - not M2's) statement earlier today regarding the mail-in votes. If anything disqualifies a candidate from serious consideration, it is the perversion of democracy. A thick, dangerous moron (again, Trump - not M2)

To add to the conundrum, I am a Brexiteer (of the mild form). So basically, I am deriding the vast majority on this board and I do so with confidence. You are all far too wed to your simplistic views, albeit with one or two exceptions.

Extending laws covering hate speech to private homes would be a “completely crazy” move that would trample over freedom of speech, a Conservative MP claimed this morning.

The Law Commission has proposed removing the “dwelling exemption” from 34-year-old legislation covering “stirring up” offences in a move that its experts argue would clarify the law.

However, critics have claimed the proposed reform would criminalise dinner-table conversations in which casual comments were made about other nationalities or groups such as transgender people.

Until 1986, the offence of using words or behaviour intended or likely to incite racial hatred could only be committed in a public place.

But the Public Order Act of that year extended offences to private areas such as people’s homes.
