This would be very sensible and is not the tearing up of the document implied by various hysterical allegations. The EU has a long history of the broadest possible interpretation of clauses that give power to EU institutions, an example is the supposed test for state aid that this causes or could cause a distortion to cross border trade, this has become interpreted so widely that virtually any commercial transaction is assumed to meet it in a formal state aid assessment. Interpretation of the protocol, particularly the provisions on state aid and competition, cannot be left to the EU.Many investors will be finding the EU fondness for international law deeply ironic. EU Member States have lost at multiple international arbitrations regarding the treatment of investors into projects in Europe. The EU has blocked the enforcement of the arbitration awards because it believes that EU law overrides international law, despite the question of jurisdiction being addressed in detail in each arbitration, including contributions by the EC itself.
