It should have pushed back like it always does, so clearly in break out territory now. Hopefully it is to be a good production update with io5 and 6 in play, but I don't see that as the catalyst. 06/8/2014 13:02 | I haven't become a Lenigas stalker, he just talked sense on one link so I checked him on another. It's well worth listening to. Not for his companies, but he has a number on the AIM and he talks about funds, when they can invest, restrictions and lots of other very basic sensible chat. On subjects that are commented on and discussed that very few understand. Note the Tesla comment and lithium, he states that retail investors research can be astonishing and he can learn more about his business sector than he knows himself. In the case of Tesla they have said they will source all their Lithium in north America but REMs resource is in Mexico. | ![]() superg1 | |

06/8/2014 11:20 | This steady march upwards on the price tends to suggest there is a large buy order in. The bid is still loaded. Sells far outweighed buys late last week and early this week but it pushed on. Traders and chartists will be confused as they sold and it kept going. Under normal rules it should have ticked back to, or just below 50p. I doubt traders and chart folk are buying now, the signals and normal behaviour don't support that. PIs I'm sure were waiting for a tick back, plus many waiting for a production update, and io5/6 news. Probably a very sensible stance. I doubt there has been much PI buying, which is the catalyst for a price jump if stock is tight. 30 mt July OK and we know they are still making adjustments. 35mt good, nice and healthy. 40mt and punters v happy I suggest. io5 and 6 producing, or starting then that would be very nice indeed. 1.2 to 1.3 mill short, it's been declining. | ![]() superg1 | |

If there's any confusion, I think it is between different sorts of hearing. First, "hearings" can be before the "Hearings Unit" or before the "Water Court". Second, those before the Hearings Unit can be of two sorts. Here's what the FAQ says: WHAT ARE THE DIFFERENT TYPES OF HEARINGS AND WHAT SHOULD I EXPECT IF MY APPLICATION GOES TO A HEARING? There are two types of hearings to which an application may be subject. A show-cause hearing is initiated if the DNRC proposes to deny an application or grant an application with modifications. The hearing will be held within 45 days of issuance of the preliminary determination. This hearing allows the applicant to provide additional information showing why the DNRC erred in its preliminary determination. The burden of proof will be on the applicant. The Hearing Examiner's Final Order will be issued within 90 days of the hearing or 90 days of the close of the record, whichever is later. A contested case hearing occurs if, after public notice, valid objections have been received on an application that the DNRC has preliminarily determined to grant or preliminarily determined to grant with modifications. The hearing will be scheduled within 90 days of the objection deadline unless all parties agree to postpone the hearing to an agreed upon date. The objectors will be required to provide evidence indicating how the criteria have not been proven. The Hearing Examiner's decision will be issued within 90 days of the hearing or 90 days of the close of the record, whichever is later. Apart from the fact that the specified hearing date of 15 July was not within 45 days of the Preliminary Determination to Deny on 17 April, this looks to me like a "show-cause" hearing before the Hearings Unit. I see the potential conclusion of that as a good thing as legally it seems heavily stacked in IOF's favour. It seems the bureau lacked backbone in awarding such a sizeable permit and passed the buck to the water court. It is very insular community up there, so in some ways I understand the pass the buck position. Decades of the same old ways, then suddenly an influx of unwanted action, no water bureau staff would want to upset anyone of influence in the community, so hand it to the legal system and let that decide. 06/8/2014 10:27 | re water rights I emailed Montana govt website yesterday pointing out that the Hearing Scheduled for date still showed 3rd June and that Hearing did not take place. I received a reply from Mr Price, Hearing Assistant, saying that the Hearing Scheduled date had been corrected, following my email, to 15 July and that the Hearing had taken place on that date. He also said that a decision by the Hearing Examiner would be issued within 90 days of the Hearing date, ie by 13th October. Interesting facts: DNRC responded to having received the original application in 60 days with the Deficiency Letter then in 49 days with the Application Deemed Correct and Complete from the Deficiency Response then 70 days later with the Draft Preliminary Determination to Deny. The Preliminary Determination to Deny took another 103 days from then. I would guess from the above that the Hearing decision is likely to take substantially less than the 90 days, say around 60-70 days from 15/7 which tales it to sometime before end September Sept Leggit/502246JMB | 502246jmb | |

Going on very old rumour stuff, if it happened I'd expect the depot to be paid for by Halliburton with reduced payment for water. Someone to discuss should the permit be awarded.
