Pre-packs do exist but by law they require the independent valuation of the company's assets. CINE's global assets have not been independently valued. PJT Partners were part of the CINE C11 team from the very outset and had a vested interested in lowering the value to only $3 billion so the court could deem CINE 'hopelessly insolvent'.

This was the key element of the Shareholder's Committee argument against the C11 proposals.

The reason why administrators have not yet been appointed one week after C11 confirmation is because there would be behind the scenes ramblings going on between, the administrators AlixPartners, the FCA, the High Court and any legal parties opposed to the application for administration.

The group Plc agrees a rescue package with its lenders and then tries to convince the regulatory authorities the company can only be saved if the group Plc is deemed insolvent.

That's not how insolvency works in the UK. You make an application for administration first on the grounds of insolvency and then your rescue package is put in place.

There is such a process as Cross Border Insolvency but it does not apply to CINE as it is registered and listed in the UK.

And should improve the labour turn over of the company !

Walt Disney are releasing 8 major movies back into the cinemas starting on 7 th July including Pirates of the Caribbean and Frozen and they think these will do better than some of the new ones but I’m sure no match to mission Impossible !

I wouldn't be so sure about that. The UK plc is going to be left with peanuts in terms of cash but it has two direct major liabilities:

1. The convertible bond was issued by the PLC, and

2. The $1bn+ Cineplex legal claim is ultimately a liability of the PLC as a consequence of a guarantee.

The FCA would suspend the stock if accounts are late no ifs or buts about it. CINE's accounts are not late as the year end has been extended to 30/06/23.

Why would shorts want the company suspended. We get paid when it goes into admin. Better for them to trade so we can add to shorts on spikes. You have no clue PWhite. The interims still need to be published but I guess CINE don't care. You can't pluck a chicken twice and it won't exist much longer so why bother with accounts. The FCA won't do much about it as there is no point.

The shares are only up because some people were shorting certain it would be suspended today. As this is no longer the case the nervous are closing their shorts ahead of any problems with the application for administration.
