Litigation Award Avanti Communications Group plc (LSE: AVN), the satellite operator, announces that it has been successful in its claim against Space Exploration Technologies Corporation ruled upon under binding arbitration by the American Arbitration Association in New York. Avanti was awarded the full amount of refund it claimed under the contract, being $7,566,013 and was also awarded interest from the date of the claim. Trading Update Full Commercial Service on HYLAS 1 successfully commenced on April 4th. The process of migrating the base of approximately 5,000 Avanti end users currently using leased Ku band capacity onto HYLAS 1 has proceeded to plan, with 10% already migrated. Several of our Service Providers also have similar bases of end user customers who are currently using interim leased Ku band capacity. Avanti is also assisting these service providers in the migration of their end users to HYLAS 1, which amounts in aggregate to over 20,000 end users. Finally, we confirmed that successful service launch has met contractual service parameters with all of our customers, confirmed their requirements for modem deliveries from the supplier and updated bandwidth demand. Based on these results, it is an appropriate time to update the market on sales progress. In 2010, Avanti specified that it was confident of exceeding a target for pre-sales signed by service launch of 25%. This target metric was useful in demonstrating confidence in the ability to pre-sell meaningful amounts of capacity before launch. Avanti is pleased to confirm that at service launch, having confirmed contracts and orders, the peak utilisation rate under HYLAS 1 aggregate contracts is 35.1% which comfortably exceeding the 25% target set pre-launch. Henceforth, Avanti will regularly report the industry standard backlog metric. The backlog statistics are now GBP139.0m for HYLAS 1, GBP28.4m for HYLAS 2. Avanti also notes a GBP113.4m option for HYLAS 2 capacity which is subject to a significant option fee. Approximately 52% of backlog revenues relates to Enterprise and Military applications and customers (not including the HYLAS 2 option), with the balance relating to SME and Consumer broadband. Avanti expects backhaul business to soon become a significant percentage of backlog. Avanti is also pleased to report that the increased credibility generated from successful service launch has resulted in an increase to the pipeline. 16/4/2011 18:49 | jonnib ... a shorter has not bought any shares in the company and therefore does not have any shares to sell So the shorter must borrow shares off somebody who does own shares in the company (i.e. somebody who has bought them, i.e. somebody who is currently long) The owner of the shares loans them out to the shorter for a fee The shorter then sells the shares in the market and takes up a short position At a later date the shorter buys back the shares to close their position and returns them to the owner Therefore an increase in the amount of stock on loan = an increase in the short position Whereas a decrease in the amount of stock on loan = a decrease in the short position | marksnsparkle | |

14/4/2011 22:22 | Gentlemen, I have recently been forwarded the following from an informant concerning Avanti.I cannot or will not, nor indeed can be bothered to, check the assertions but, if they are sound, AVN looks set to soar: "I have closely been watching the bulls vs bears fight on Avanti via the bb on ADVFN. I am invested (not short) and I'm very much enjoying the "battle". At the time of writing it doesn't appear anyone has realised (or I may just be totally wrong) but the directors have been on a recent stock buying spree ( perhaps they should be made to declare such purchases in RNSs to give ordinary investors the chance to buy in). Furthermore after literally seconds of painstaking research I have discovered that AVN already have one satellite in orbit (who knew?) - I hope I'm not jumping the gun but surely this information needs to get into the public domain to give those who are short a sporting chance to close. I have also found the following comments from David Williams , Chief Executive of Avanti Communications hidden away in plain view on the AVN Website where no one could be expected to find them. "The in orbit testing phase of HYLAS 1 has been a complete success and puts us in a strong position for future growth. "With Europe's first fully operational broadband satellite, Avanti will now provide a range of satellite data communications services to consumers, enterprise and governmental organisations across the UK and Europe. In such a vast market with so much growth in data demand, and a strong customer base already committed, we are highly confident of achieving rapid commercial success for this powerful and flexible satellite." And... "The signing of this contract is significant since it further demonstrates that expert customers in Europe choose to work with Avanti. We offer a flexible, service oriented approach and reliable and well regarded technology. Avanti has announced a steady flow of contract wins in the last two years which underpins our confidence in fully utilising our satellites at attractive prices." Also... "I am pleased to welcome these new service providers to our system. I hope that the HYLAS 1 services they have bought will help them grow their businesses as well as deliver broadband solutions to the unserved populations in Scotland, England and Spain. I am also pleased to see that customers continue to choose Avanti because our product is competitive and our approach is flexible." He may come across as downbeat and conservative in his tone but I am led to believe that is just his manner. AVN has also announced the launch of its Space Scholarship Scheme which has been set up to encourage young people to pursue a career in the UK's rapidly growing space industry. Alas it appears they are not the first to do so as a few fully qualified space cadets have already been observed posting on the AVN BBs. Until the next exclusive snippets ..." Out comes the pr about how spacious it will be, extra services etc etc but in reality its the same old cattle class for the majority and a few will pay for the extras which have to be at a premium.
