Defamation on internet bulletin boards is more like slander than libel, a High Court judge has ruled. Mr Justice Eady said that bulletin board discussions are characterised by "give and take" and should be considered in that context...

Mr Justice Eady said that Smith had persistently pursued cases which were without merit and issued a civil restraint order against him, barring him from starting further actions. He later conceded that he could not do that, though, because he had stopped lawyers arguing about a civil restraint order in the course of the trial.

He did, though, order the continuation of a general stay on those cases which had already been begun.

The posters on the bulletin boards had criticised Smith for what they saw as heavy-handed behaviour and the issuing of threats of legal action by Smith when criticised. One said that he supported "those who were being threatened and bullied by … Mr Smith", and called Smith a bulletin board bully.

realistically, though, the FCA is a paper tiger?
- its record of bring successful prosecutions in
cases of alleged complex fraud etc is very poor.

all that’s happening on lse is a single pi who
has lost out is complaining, whilst another
poster who claims to be running free on both
WRN & whetstone is posting updates from rapid.

remarkably few posters on lse have commented on that
recent news that GSC was quietly offloading in march.

Threats of legal action against posters are very common. None have been successfully sued. Most claimants back out before a claim is even filed, the very few that have been filed have resulted in failure and significant cost for the plaintiff - see the multiple threats made against TW for example.

Do you or anyone else really think if a genuine action was being prepared with genuine legal advice a sociopathic criminal like Chapman would be allowed to go around posting about it and making threats regarding other forms of harassment and intimidation he intends to subject defendants to?

As has been fully explained any attempted claim would be fatally flawed in every possible way.

The best thing to do is simply to filter posters making ludicrous and interminable threats about litigation which just ain't gonna happen.

Strange that Chapman, the hot air balloon, was so keen to have a litigation thread but now there is one he tries to trash it. It was the same when a thread for WHET was started, he and the team shills were not interested, nor were the shareholders come to that.

The hot air balloon is in full flow I see, they must really hate anyone talking about their dealings! If so they should have stuck to their small companies and avoided WRN and the BB following. If he gives any links to litigation against Stevenson, TW, Green or Ahmad will someone please post it again for me to see.

I really fail to understand how anyone can be sued "millions" for posting on a public BB thread - like thousands of others - especially on two suspended shares. I read similar on other threads - unjustified ramps or negitive comments - no one ever gets the threat of legal action - so why here? He really should Google online harassment law for a start. They have had five years to press for litigation against various parties. None has happen. I do wonder why they want to shut down debate here ...because so far it's having the opposite effect!

MELTDOWN!

Disclosure rules require any info harmful to the case to be disclosed. If it is ex parte, ie a pathetic attempt to ID people, that disclosure has to be up front in the claim or the claim will be kicked out when the court becomes aware of it - Ie exactly what happened with AE's ex parte injunction against TW back in 2015.

WE LEARNT THAT THE TROLLS IN PARTICULAR WOYBORE AS USUAL WAS WONG

THEY/HIM WAS DESPERATE TO TALK HIS/THEIR USUAL TOSH AND TRY TO CONVINCE READRRS THAT ALL LITIGATION WAS “OUT OF TIME”

WELL WE KNOW ALL KNOW THAT NO LITIGATION IS OUT OF TIME AS WAS EXPLAINED IN MY LAST WEEKS POSTS
