IG poor results appeared to have a negative effect on our share price but their struggles should be our gain in my opinion. This is recovery of Israeli tax to reduce withholding rate to 15%, in accordance with double tax treaties, irrespective of UK tax liability. Bearing in mind ESOP want claims to be submitted by this week, point now pretty academic, but might be worth requesting your Inspector to review to ensure future recovery . | stuffee | |
15/7/2019 22:48 | HMRC filled in their part of the form differently on different occasions, when I queried it, the eventual outcome was that you were not allowed to reclaim the tax for shares held in an ISA. I think this was because the income wasn't subject to tax in the UK. I think that's probably quite normal with double taxation agreements, that the ability to reduce it is on the basis it is subject to tax in the home country. Given the confusion etc, I'm not saying you won't manage to do the reclaim, I'm just saying my understanding is you're not actually allowed to if the shares were held in an ISA. But obviously get your own advice / check with HMRC. | alan00 | |
15/7/2019 20:37 | Alan I’ve reclaimed Israeli WHT on ISA income for several years now. Providing you submit Israeli form, signed by your local UK tax office, confirming you are UK resident et al and other docs, and confirming receipt of income, all should be OK. Bit tedious the first time but relatively straightforward thereafter. I’ve always found ESOP quite helpful, but they do have tight timetable. I wonder if your UK tax office was confused and thought you were trying to recover from UK Revenue? | stuffee | |

15/7/2019 20:13 | Seems to be some confusion at HMRC, but ultimately they said you couldn't claim the 10% tax back for shares in an ISA. I think the reason being that the income hasn't been subject to tax in the UK (as it's in an ISA). They completed the forms different ways different times, but the above was my final conclusion when I queried. | alan00 | |
