02/10/2009 17:53 | Had dealing with the customer service department and currently thinking of taking legal action against the company - please read my letter to them after purchasing a pair of jeans from the Hugo Boss store, Meadowhall, Sheffield. Dear Sir/ Madam, I purchased a pair of Hugo Boss Jeans (JNSCBUSEDHB3120HBO) from the Meadowhall Hugo Boss store located at 23 High Street, Meadowhall Centre, Sheffield, S9 1EN on 28/9/2009 at 1630 BST. After 1 day of use it was apparent that one of the orange threads which attaches the Hugo Boss label to the rear of the jeans had broken. (see photograph 1) . On 1st October 2009 I took the defective jeans back to the Hugo Boss store in Meadowhall. I spoke to the general manager 'Mr Nasar Hussain' at approximately 7pm and asked for an exchange. From the very onset of my request for an exchange Mr Hussain implied that I had worn a belt under the Hugo Boss label, which was the underlying cause of the damage. He told me that he was unable to exchange the jeans as the product was no longer resalable. Mr Hussain said that all jeans at the store were tested before sale and as such I was completely responsible. As I have said several times to Mr Hussain and I will clarify now in writing at no time during the use of the jeans did I ever wear a belt under the label. As it was apparent that Mr Hussain was unwilling to exchange I asked to see the terms and conditions of sale as the receipt stated that ''Moss Bros Group PLC operate an exchange/ refund policy. Please see notices in store or ask a member of staff for details" The terms and conditions as displayed in the Meadowhall store and on your company website say "For faulty merchandise, we will happily rectify the problem, refund the price paid or offer an exchange of goods to the same value. Proof of purchase is required" I quoted this to Mr Hussain and showed him my receipt but he was still not happy to exchange/ refund the product. I also stated that the product was not of merchantable quality and Mr Hussain still refused to exchange the product. On 2nd October 2009 I spoke to Charlotte in Moss Bros Group PLC customer services at 0936 and explained the situation. Charlotte said that she would contact me towards the end of the day. I had a discussion at 1655 with Charlotte. Charlotte informed me that she had been in contact with the store manager in Meadowhall. Both Charlotte and the manager of the store both are unwilling to offer me a refund or exchange and believe the broken thread was not a manufacturing fault. Under the 1979 Sales and Goods act the retailer is responsible to ensure the product is of satisfactory quality and fit for purpose for a reasonable time. I feel £100 for a pair of jeans with only one day of use, and two days under my possession is not of reasonable time. I have asked for a refund or exchange under your terms and conditions, which you have refused. I have also informed both the manager at the Meadowhall store and customer service manager of Moss Bros PLC the trade descriptions act and your terms and conditions of sale. I believe I am entitled to a refund or exchange. I hope you will reconsider your position otherwise I have no other option but to seek legal advice with the view to pursuing this dispute in the small claims court and also contact Hugo Boss AG in Germany. Mid-30s looks like an area of tough resistance, though - I don't think we'll break above that area any time soon without some significant positive surprise in the newsflow. | bletherer | |
