As per yesterday's RNS: "As announced on 1 March 2024, existing senior lenders have agreed to waivers including the deferral of interest payments until the 29 March 2024. There is no guarantee that an agreement will be reached with senior lenders with respect to further extensions of such waivers. The Company is a guarantor of ANML's debt under the senior loan facilities. If no agreement is reached and if claims are made in relation to the guarantee, the Company may also need to consider applying for protective measures that may be available to it, or in the event that a re-financing and re-structuring solution for the group is not achieved." [my bold] So the lenders have voluntarily agreed to waivers and interest payment deferrals up to 29 March. That the group have had to implement the Brazilian creditor protection procedure implies that the lenders must have indicated that they were not going to extend the voluntary waivers/interest deferral beyond 29 March. So the question is, when we get to 29 March, are the lenders going to seek to enforce and to protect their position to the maximum possible extent? That would mean, for example, looking to enforce the guarantee in the UK against the listed UK holding company "Horizonte Minerals PLC". Personally I think that that's more than probable, so a probability of around about 75%. From the position of the senior lenders I can't see any downside to seeking to enforce and yet there's definite benefits. Why wouldn't they look to protect their position to the maximum possible extent? So we await an RNS either on Fri 29th March or Mon 1st April telling us what action the senior lender has, or has not, decided to take. JakNife | jaknife | |
