MW did not do this as some exercise of free speech but as an attempt to disrupt markets and make money. If Burford can prove that, then I doubt the first amendment applies and damages should be recoverable. Our early investigation already shows the hallmarks of market manipulation." Thanks for that, no longer a direct legal threat just a vague hint of one which they will drop or tone down further. They might have had a chance in a UK court, but already picked up on the clever wording that would get MW off the arguably insolvent bit is already in the rebuttal, but there are lots of other assumes and our views which would give them an honest opinion defence in UK. But under US speech laws they would have to go after MW in US where under 1st amendment their defence is even easier. There is a very strong correlation between companies who threaten legal action after a short attack under performing those who do not. There is also a strong correlation between those that come under short attack still long term under performing the market when the short attack is over. There was a short attack recently by QCM (Gabriel Greggo who took out Globbo and more recently Follie Follie) on an Italian AIM company Bio-On. The Italian AIM has an automatic volatility suspension mechanism which does seem to be a good idea as it stopped the massive swings we have seen here. Something like that would make it more difficult to do a smash and grab raid and for the shorter to gain he would need to be proved right rather than the situation here where MW could have easily closed yesterday and reopen shortly before the next round. I personally do not have a problem with companies being attacked, they either fight it off because the shorter got it wrong or they are not worth what they were trading at. It is all the uncertainty in the middle which can ramp up unfair losses to PIs who don't know how to handle the situation. My view remains BUR was grossly overvalued and when the dust does settle it will trade at a more sensible and realistic value, but is likely to swing violently in between. Some will gain from that and some will lose, I think it is better all round that a volatility suspension mechanism prevents the disorderly market. | ![]() sweet karolina2 | |
