It depends what the affidavits stated.

"What is an affidavit?

An affidavit is a written statement from an individual which is sworn to be true (an oath) which is signed by the affiant (the person making the oath) and also a notary public or other judicial officer that administered the oath. An affidavit must be made voluntarily and under either religious oath or affirmation. It is therefore required to be signed in front a person commissioned to receive oaths under legislation, eg. a solicitor."

Simon - that could be for a few reasons. They could have no defense to what you have alleged....or it coul dbe they have been told by their legal team that there is no case to answer.

It's not done them any harm so far, has it?

For what its worth i think it's blindingly obvious that the Key to the future of EKT lies with Graham Edwards. People like him do not invest millions in a company like EKT, rescue it from the mortuary slab, put a man on the Board and then sit back and watch the directors milk it dry and send their investment down the pan unless they have an agenda. I suspect even now GA is running this in a way that exactly suits himself and probably the other large holders. There really is no other explanation why such experienced and well financed people like GA, Perloff and Kinder would back such a loser and not step in...

Simon - just because the vice chancellor has allowed a further submission of a contempt action doesn't mean that guilt is inevitable.

From what I have read, the judge has allowed you to resubmit as the first one contained errata. I don't see how a leap from this to "compensation all round" can be gleaned.

To all those doubters who appear to think management can carry on milking this company by paying themselves excessive pay and bonuses, why would the Vice Chancellor have stated a further contempt of court action out if he thought there was no case to answer?

There days are numbered now they have gone to far and the more they take out the company the more compensation they will have to pay back.

Have been watching Versarien Video on You Tube when Elektron lost Neil Ricketts they not only lost someone who had a vision for the future they gave away the copper technology as well, to maker matters worse they also sold Total Carbide for a song. Seems TC has contributed £4.5 million of revenue since acquisition and is recently seeing an upturn in the oil and gas industry...



I am amused at Elektron calling themselves a technology company when they have virtually given up on any sophisticated technology.

Pug, the Bulgin subsidiary is worth more than the present market cap alone and worth more to a vulture fund or a connector maker.

However Daley is part of a concert party so he can make it awkward so far a bid was concerned.

I have no doubt in my mind he would have liked to take this company private but he will never be allowed to while there is a claim still outstanding.

I have made my position clear to management lawyers I expect full restitution here and that also means any wrongdoers are punished for all the wrongdoing and I do not intend backing down on these matters.
