The reason is, according to the petition, that Ávila previously sponsored or represented cases that are related to this process. The excuse is a legal mechanism to ensure that the judge acts impartially.

"The fact that Dr. Avila is currently a judge and before being a judge has sponsored cases that are directly related to the matter submitted to constitutional review, making it difficult to guarantee that impartiality," says the Chamber of Mining."

PIs are always the last to know but this mornings share price action would dictate that certain fractions already know the outcome of the CC?

I think fsawatcher will be proved correct with his “snitches̶1; :-) this should be back in the 40s in short order with a positive announcement, possibly even higher with the current Gold and copper upswings combined with a scramble to get back in.

In the unlikely event the Constitutional Court were to approve the referendum, the question would then have to be approved by the Electoral Council in order to be included on future ballot papers for the provinces specified.
