Dear WayneB, I think that the status is the same whether or not your shareholding be dematerialised in a nominee account or held in paper. Either way you have proof of ownership and that's what will always count if you needed to prove your entitlement to say write-off value or some other form of residual value.

Just when you think it could not get any worse i was thinking i would hold a few shares in the new company,if you hold your shares in a nomonie account crest have removed your shares so your broker has had to remove your shares from your account. My broker Lloyds Tsb have told me i no longer hold any of these shares and cannot get them changed to paper certs, also if the company goes into private ownership i still will not have any shares, the only way i would get any shares back is if the company gets a new listing(pigs might fly),yet if you hold in paper certs you still have the shares and will get new shares issued. Can anybody tell me if this is right there must be other holders in a nomonie account ?????????

Thanks wayneb

wayneb, thanks for update. We are all aware that we have been wiped out but at least this will take us out of limbo and we can offset the losses.

I have just has a talk with Ian Williams and the company is going to call a AGM as the CVA time ends in the middle of June so something has got to be done,if what i was told does go through they are going to increase the share capitol to pay the debt off with shares then have a share consolidation of 100,thousand to 1,so we will be wiped out and get nothing by the sound of it .

from reading the above it would appear that we are truely screwed. The stock is worth f.a. but we still can't offset as a tax loss. How bad can it get?

Well,4 million pound debt and they were going to get 1000 shares for every pound of debt, that will make a lot of new shares and wipe our holding out me thinks

Hi, this is the text of the letter that I received from Ian D Williams (Supervisor) of BenedictMackenzie re: Arthur Shaw & Company PLC (Subject to voluntary arrangement)

"The company is in a Company Voluntary Arrangement and it has no assets. It is intended that its liabilities of £4 million will be swapped for new share capital which will rank equally with the shares of the kind that you hold. When and if that is achieved, the company will be solvent and non-trading. The directors intend that it should commence trading again and they hope that it will eventually become a quoted company. Your shares may, then, acquire some value".

The phone number for Ian D Williams at BenedictMackenzie is 0207247 1174.

Yes it looks like we have lost the lot on these, they could have done this 2 years ago and not kept us hanging on hoping we would get something back

Looks to me that the whole lot is a write off - and we 'small' investors will get zero.

I rang the administrators today and it is not looking very good.they cannot agree on a deal with HM Revenue and Customs, they are creditors, but not the largest, they are going to be paid in shares, they were not in agreement with the cva from the outset,so as i see it they do not want it to happen. They have until June to get the deal done if not it will fail and that is the end of Shaw

which would mean that Brian Morrison also gets 1 share for every 1000 old ones, but I'm sure he's got some clever lawer working on that one.

Well March is here,i will give it to the end of the month and give them a ring, hopefully they have got ot sorted with HM Revenue and Customs by now,and will be able to issue new shares soon. This is probably when we discover we have got one new share for 1000 old ones if we are lucky.

i too have STILL not had a reply from the Adminastrators to Date (Big surprise i think not)
my wife has only just come out of hospital so this has taken a back seat but i intend to contact the adminastators again (just to ensure i receive a reply) I Hope!!!.
i do not know what other course of action we can take ( HAVE YOU ?)

I agree with you that i do not think they are going to wind up the Company.
There were several major contributors who put quite a lot of money in to the Company in the recent past (2001/2002) can not see them just wasting that investment.........

but as to what IS happening we are completely in the DARK

i still have not had a reply.I think we will be lucky to get anything back off these, but there may be some hope as i cannot see why the company are going to issue new shares(i was told that this is what they hope to do when all the creditor have been sorted) just to wind it up
