21/3/2014 09:42 | Well my 'guess' is that IOF will have used the time to gain LOIs for any outstanding or additional customers to maximise their position. No idea on timelines, but the 60 days are will be up soon. Other parts like water available and engineering are done as in the rns. Some may wonder why letters of intent v contracts. It's illegal to gain a contract for a permit you don't yet have. As IOF have the other options, USFW rights swap and the discharge permit, that meant the Hal deal was fine, but for direct supply for an applied for permit, the best you can do is LOIs. Much like the host of large retail companies over here that in their sales policies have factors which are in fact lies and deceit. Following the Distance Selling Regulations, we will accept items back even if you have opened the goods to inspect them. You are entitled to a refund as long as you return your goods within 7 working days* from the day after delivery. The goods must be in an 'as new' condition and returned in the original, undamaged packaging, along with any accessories and free gifts received with it. The company involved rhymes with Currys lol. From their website, the above contains lies and deceit v distance selling rules. The point being the, rules and legal systems can be very complicated, and when you go down the legal route the ball game changes, opinions are pretty much useless v law. Anyone reading the above would take is as correct, and no doubt have it spouted at them by some teenager that was told the above in training. 21/3/2014 07:34 | Engelo Coincidentally I was very positive in posts re any advance to a hearing. There are water rules and laws. The bureau can't just deny someone for the sake of it, if they meet the standards, as Bob Shaver (ND) said, by law they have to award the permit. The fact is, in a hearing it becomes a legal argument. The basic rules are, water available, a use matching their beneficial use list. That's basically it. The water is available, and they have the beneficial use identified and covered with letters of intent. So legally the water bureau would get nowhere in a hearing. Most hearings end up with award of the permit. The ones that are not awarded are generally down to criteria not being met, or the claimant not turning up. That imo is why George made the comment. I think it will be awarded. All I consider is that they may be deciding in how much to award. That point is well covered in the rules. | superg1 |
