16/3/2019 12:03 | Fozz, The criticsm of Hope / OMF counsel relates only to the way they applied for an unjustified variation. The variation has been removed - there was never a need for it because Hope and OMF hold all the aces - at one point the judge describes the protection OMF has in the 2016 notes as bionic (para 53b). On this point of legal masturbation alone FRR had a realisitic prospect of success in the appeal court so the judge changed his mind blaming OMF counsel. On the important issues relating to Hope position on the board and power of veto that has all been reinforced by this judgment. "The present dispute cries out for commercial compromise rather than final judicial resolution" Plus "my robustly finding Plaintiffs' [FRR] substantive breach of fiduciary duty claim had no prospect of success" Is as clear as it can be. FRR need to fold and give OMF the assets because they are only going to lose badly when it finally comes to court. Read para 13 which quotes para 35 of a previous judgment, especially note "strongly arguable that FRR is insolvent ... this lends credence to the propriety of Mr Hope's general stance" | sweet karolina2 | |

The way I read the court documents was that Judge K was scathing in his condemnation of Hopes counsel. The main body of the document was made up of the judges criticism of Hopes counsel. The court document ends with the judge saying, in a round about kind of way, that based on new information and changes in circumstances since the last hearing that FRR now have gone from no chance to "a realistic chance of success". Ref BP and the loan, all unknowns for now, no point in second guessing till the oocs is announced. The company is delisted and I've no access to my investment, on Christmas EVE investors had little hope, now there's "a realistic chance of success" of beating Hope and claiming $56m in damages.
