17/9/2018 16:43 | I'm not sure if, technically, YA will have sold forward at all. The way that death spiral companies normally operate is that they are given a slug of shares as a "fee" at the beginning of the operation. They are able to sell these without officially going short. In reality, however, they are forward selling the next tranche that they know they will receive by converting their preference shares. if the shares don't get delivered for any reason (unheard of, prior to this), then they have simply sold their "fee" shares. Under normal circumstances, they keep hold of their "fee" shares and simply end up having sold the tranche that they knew they would get. Right at the end, once all money has been recouped, shareholders have been rinsed, and their profits made, the death spiral outfit will sell its "fee" shares. I don't think they ever go short. It sounds to me that YA will have to use their "fee" shares to settle their forward sales and they have taken great umbrage that FRR are reneging on their contract, so have now demanded that the loan is paid back in full in cash. | ![]() wshak | |
