13/11/2017 09:07 | So what might the inspector say at the end of this farce ... a) I have to decide whether or not NLC were correct in refusing this planning application. Their reasons for refusal given at the committee meeting were basically not enough information and a distrust of the Government Agency which is empowered to oversee such developments. I conclude that these were not reasonable grounds for refusal and the decision at best should have been deferred. b) I then have to decide has sufficient information been provided to me at this hearing in order to determine whether or not to grant the appeal. I find that there has been and I will allow the appeal subject to the following conditions: xxxxx c) On the matter of costs I find the actions of the NLC planning committee unreasonable. They have previously allowed Egdon the expense of drilling a well which successfully found hydrocarbons then subsequently refuse them permission to extract them. They also refused a 12 month extension to the retention of the site while this appeal was being heard yet they allowed permission for Egdon to go ahead and drill ground water monitoring boreholes. I find that this behaviour disgraceful and as a result I find for EGdon in the matter of costs. d) to answer some questions put by the public: extraction of oil onshore UK will have a nett positive effect on the environment as it clearly reduces the amount of oil needed to be imported into this country and in addition it will obviously have a great benefit to the local and national economy. e) to put the risk of contamination of ground water into persepective - the oil will be extracted by a pump - it is not a 'gusher' - the worst case scenario is that a bucket of oil may be spilled by someone cleaning up the basin surrounding the oil tanks and that is hardly likely to jump on it s own over the barrier surrounding the site or through an impermeable membrane downwards. Some of the arguments put forward about this membrane were frankly ridiculous and not worth considering. Can't imagine he will say much differently | jusmasel99 | |

10/11/2017 15:03 | DEcision date will be announced next week - could be early January North Lincs dug their own grave with the questioning - errors or no errors by ourt consultants. Fact is there was no reason for refusal only for deferment and eventual suitable conditions. If they are arguing that the impermeable membrane isn't the right one then that is not a reason for refusal if stated as a condition it is strengthened. For goodness sake - asking what might cause the impermeable membrane to leak? And the coup de grace I am sure will be delivered soon enough when Egdon explain the quantities of hydrocarbons that could potentially leak here. Drips. If you read the documents they submitted they even had to explain to North Lincs experts that oil actually floats on water. North Lincs fighting to save costs being awearded against them only and I don't think its going to work. 10/11/2017 11:59 | I think we need to take into account that what we are reading is written by an 'independent' reporter on a site reporting news for the opposition, so unclear exactly how neutral the reporting is! I suspect that there may well be a leaning towards the oppositions POV rather than with the Egdon's witnesses etc albeit the reporting does suggest several errors so far but exactly how serious these are or what effect they have on the drilling is unknown.I suspect that lots of mountains are being made out of molehills!! | cheek212 | |
