12/8/2020 19:22 | Anyone got an opinion on the legal issue regarding the fuel and paying full whack when CEY believe they are entitled to subsidised local pricing thereby being taxed heavily . The latest RNS states the Egyptian Administrative Court gave oral judgment on 20/6/20 which seems to throw out the EGPCs claim for extra duty for the period the company received subsidy ( good ) but also that PGM ( CEY ) claim that they have overpaid since was also thrown out .. both on the basis of admissions were not made within the prescribed time limits . PGM is to appeal on fact of law but it does seem to me the Egyptian government are applying delay tactics to a perfectly valid claim which seemed to have come off the back of the challenge to the 160km2 square lease which is still subject to appeal pending a review of another law but the main reason quoted is the court was not provided with the copy of the original lease clearly showing the 160km2 area ... otherwise we end up with 3km2 to mine 😂 Anyway .. it seems to me CEY / PGM ( Pharaoh Gold Mining ) are confident there case is legally tight but are treading on glass with the Egypt government . I don’t think they are reserving anything for repayment of the fuel subsidy they could be entitled to and I am guessing the legal costs for both cases are just being written off as unrecoverable? Interesting issues in the background . In respect of the fuel subsidy ... the best answer for CEY to deal with this is get the solar plant commissioned and built thereby reducing the fuel dependency and cost / reducing the risk of power cuts and bringing down the AISC ... which would be very good for shareholders .
