Gee: Upon Stipulation [85], IT IS HEREBY ORDERED as follows: (1) That the hearing on the OSC re: Preliminary Injunction is continued to 1/11/2013 02:30 PM before Judge Dolly M. Gee, to facilitate the parties' continuing discussions regarding a resolution of this action; (2) That the TRO shall continue to remain in place until the Court rules on Plaintiff's motion for a preliminary injunction; (3) As previously ordered, pursuant to Local Rule 7-8, Plaintiff shall produce at the preliminary injunction hearing on 1/11/2013, for live cross-examination declarants J.C. Weigelt and Jeffrey Chateau, who have agreed to appear for the hearing; and (4) That Plaintiff shall have an additional ten days in which to respond to Defendants' counterclaim. It seems the court hears these cases on a Friday, the longer delay probably due to reduced court availability over the "holiday" period. Note reference to continuing discussions. The interim accounts are due by the end of December, that is the best opportunity to update on strategy, but they are probably being delayed until the dispute is resolved.
