The fact these guys are still talking sounds like they have the basis of an agreement. Just the fine detail to fix. Who's to say they get this wrapped up for the holiday season?

Cafepharma is correct, case delayed till 11 Jan, text from court docket below:
ORDER ON JOINT STIPULATION CONTINUING HEARING ON OSC RE: PRELIMINARY INJUNCTION by Judge Dolly M. Gee: Upon Stipulation [85], IT IS HEREBY ORDERED as follows: (1) That the hearing on the OSC re: Preliminary Injunction is continued to 1/11/2013 02:30 PM before Judge Dolly M. Gee, to facilitate the parties' continuing discussions regarding a resolution of this action; (2) That the TRO shall continue to remain in place until the Court rules on Plaintiff's motion for a preliminary injunction; (3) As previously ordered, pursuant to Local Rule 7-8, Plaintiff shall produce at the preliminary injunction hearing on 1/11/2013, for live cross-examination declarants J.C. Weigelt and Jeffrey Chateau, who have agreed to appear for the hearing; and (4) That Plaintiff shall have an additional ten days in which to respond to Defendants' counterclaim.

It seems the court hears these cases on a Friday, the longer delay probably due to reduced court availability over the "holiday" period.
Note reference to continuing discussions.

The interim accounts are due by the end of December, that is the best opportunity to update on strategy, but they are probably being delayed until the dispute is resolved. Will be interesting to see how the statement reads.

Co could update the market- I would say it is overdue. Just because it is on Cafepharma BB does not mean it is correct. In the Public domain in the US on court papers accesable by but a few is not in the Public domain here. They should say something for those that don't know.

but I dont see the neccesity to keep delaying it looks to me like STJ are messing about

The disappointing thing is the lack of clarity. We heard via the court reports that we had an extension form 30 Nov to 7 Dec to discuss and see if they can sort ..then nothing ..did they get another extension? are they still talking? did the court hearing take place on 7th Dec?

I have voiced my thoughts on Mr Pither. Maybe the board are tied up with other business matters? Don't forget the courts have said that we are in discussions to resolve the dispute. This bodes very well for Aortech.

Interim Statement must be due soon, does anyone want to start a rumour that Pither is resigning and in recognition of the value he added to the company during his tenure as chairman, he has agreed to pay back all fees paid to him during that time - sounds fair to me.

Why does Pither remain as a director????
