What we can all agree on:

1.The other company is delaying as long as possible to reduce current value of the pay out. ((They may also have cashflow issues.))

2. This suggests they haven't got a strong case.

3. It doesn't mean though that their case is NECCESARILY without merit: even if it had considerable merit, it might still be worth their while postponing the decisión date. After all, we are not expecting PVCS to pay THEM, even if there is a negative outcome for PVCS.

4. PVCS would prefer a mediated solution, provided it meets a mínimum threshold. There is uncertainty in the arbitration process: they might get a bad result.

5. Likewise arbitration is preferable to going to a trial. As this is more expensive and time-consuming, and, of course, is at least as uncertain as arbitration.




In the meantime, in the last few months, wafer prices have firmed up dramatically. Polysilcion prices have improved too. However, given a relative lack of current orders for cells, we might expect wafer and polysilicon prices to fall back.

We can only work with what we know and assuming their supply contracts are all the same then they will win at arbitration as they have already done so in the past.
In addition the delay on going to arbitration was asked for by their customer not PVCS so it is clear who wants to avoid arbitration.
All the facts that we know point to a customer dragging their feet while PVCS wants to get to arbitration.

As for why the other party simply not bidding for the shares - well, there is no certainty a bid would have been accepted if it became apparent the bidder was doing it to prevent paying out, and, additionally, the counter party might think they have a chance in winning the case.

Not so - PVCS are keen to settle in advance of possible is my view. One can never state with certainty the outcome of proceedings...

My own feeling is that they will end up going to arbitration.
Why would PVCS settle for any less than the full amount they are pretty much guaranteed to get from the formal arbitration (based on settlements previously achieved through arbitration)
My guess is that the company have just used negotiation as a tactic to delay any payment and going to arbitration will give them another 3 months.
What I don't understand is why the mystery company didn't just make an offer for the business when the share price was under 10p. They could have offered 20p and ended up with the company for probably less than the settlement value.

Not so - mediation ongoing. It might continue right up until the hearing, which oft occurs.

It means mediation is ongoing, with a hearing listed for end of March. If they can get a deal in advance, then so be it. If not, they feel they have a very strong case to take to the hearing. Either way looks good.

Well, we are almost in March so they will either have to say that they have done a deal or they are going to arbitration as I don't think that anyone will accept any further delay in resolving the contract issue.

The shares are significantly undervalued in view of the very likely resolution to the supply dispute. And wafer prices have firmed up dramatically over the last few months. New buyers may have noticed this and hence pushed up the price.

So there isn't necessarily any immediately pending news. Still I hope there is.

Well, we're nearly half way through February, I'm trying to remember the disclosure rules, but I think all the heavy casework kicks in about now? Sensible types make offers now, stubborn ones get fleeced by two sets of legal fees...

Personally I expect a statement imminently from them so I would not imagine they would want to say anything of a material nature.
