Was somewhat tongue-in-cheek ;) I think the outcome delay is an even bigger effect than the (minimum) doubling of discount rates - & so far seems little sign of things speeding up. This coupled with the case settlement turnaround makes the returns a lot less attractive, potentially not attractive at all.
