Good morning,
We all met in Leicester last year. In response to your invitation for comment, I would welcome the appointment of an administrator. The evidence that the company was used by N Bourg and L Foucher (through Niel Infrastructures SA, itself bankrupt) is now incontrovertible. The onward movement of funds to SIM, related as it is to the Cooper family, should be investigated in this light by the UK authorities. The Insolvency Service should now be informed by the company ahead of further commitment of funds to directors and advisers. The creditor seeking the order should be made known to other creditors before the hearing to enable a creditors meeting to be held.

In short, Mr Kanabar has a great incentive to keep insolvency practitioners out of the company offices, especially insolvency practitioners appointed by a court rather than by himself.

This story is much bigger than just the corrupt Afferro deal. The IMIC website still has the largest single shareholder as being Niel Infrastructures SA. This company is part of the Group that tried to buy New World Oil and Gas plc in 2014-15. One of the directors has testified in court that he was working on behalf of Ilyas Khrapunov, a Swiss based Kazakh wanted by the authorities in Kazakhstan for his part in the embezzlement of $bns.

And in case you think that 2014-15 sounds a long time ago...

My view is that even if there are any assets left at all for creditors, which I doubt, we will be so far down the pecking order that there will not be a hope of even a sniff of any reward. In fact it would be wise to hold your nose, just in case!

On the other hand, a timely complaint to the FCA regarding the deal that was done between IMIC and the old directors might raise an eyebrow, but don't expect any action, just do it out of a mischievous sense of revenge.

It is the Company’s present intention to oppose the grant of the Order.

Should creditors, shareholders and/or other stakeholders wish to support or oppose the Order, they are invited to contact the Company, in writing, before noon on Tuesday 3 April 2018, so that stakeholders’ views can be fed into the process.

Stakeholders may wish, in due course, to submit formal witness statements by noon on Tuesday 3 April 2018.

The Company is not in a position to provide any advice to any stakeholder as to whether to support or oppose the Order.
