It's also the case that we knew nothing about the court case until Sudani mentioned the ruling in parliament so we may not be told whether or not the MoO have appealed either. Let's hope that when the 30 days IS up we get some sort of announcement. I don't see much point in them appealing because they would be going against the ruling of the London Court of Arbitration which is where the whole sorry mess would end up. And as that court has already ruled in favour of the Kurds then Baghdad would lose. And Baghdad knows that. | habshan | |

The Karkh court in Baghdad has rejected the annulment of the contracts of the Kurdistan Regional Government (KRG) oil companies. Prepared by Bzhar Zuber for Rudaw International oil companies operating in the Kurdistan Region of Iraq (KRG) have won a major legal victory in Baghdad after the Karkh Court of Appeal rejected a request by the Iraqi Oil Ministry and quashed previous court decisions nullifying contracts between the companies and the Kurdistan Regional Government. According to the Iraqi Oil Report, the Karkh Court of Appeal issued the decision on November 18, ending the legal campaign of the Iraqi Oil Ministry against nine companies, including; Adax, Dana Gas, DNO, Gazprom Neft, Ganal Energy, Gulf Keystone, HKN, Shamaran and Western Zagros. The Karkh court ruled that the contracts between the companies and the Kurdistan Regional Government (KRG) are legal, although the contracts are based on legal principles that the Iraqi Supreme Court in February 2022 declared unconstitutional. The Iraqi Oil Ministry began filing a lawsuit in May 2022 to cancel the Kurdistan Region's oil contracts, shortly after the Iraqi Federal Supreme Court ruled. In July and October 2022, the Karkh court issued a number of decisions to annul the contracts of Adax, Genel Energy, Gulf Keystone, HKN Energy, Shamaran and Western Zagros, but there was no public decision for Dana Gas and Gazprom Neft. After that, the Kurdistan Regional Government's Ministry of Natural Resources filed an appeal, which was finally decided this year. In August and September, the Karkh Court of Appeal rejected previous decisions. After that, the Iraqi Oil Ministry once again appealed to the court to nullify the contracts. After several delays, the court met in November. On November 18, the Karkh Court of Appeal issued nine decisions on each company's case, rejecting the Iraqi Oil Ministry's request to nullify the contracts. But the Karkh Court of Appeal's decision will not end the headaches of the oil companies. Although the decision ends a specific legal issue, it does not mean that the government and federal agencies will support the Kurdistan Region's oil contracts. Because the contracts were made based on the 2007 Kurdistan Regional Government Oil and Gas Law, a law that is considered null and void by the Federal Supreme Court. Therefore, the oil contracts of the Kurdistan Region are returning to political and legal turmoil. That is, the contracts are not null and void, but the Iraqi Oil Ministry can say they do not comply with Iraqi law. The November 18 decision coincides with political efforts to resume Kurdistan oil exports by pipeline to Turkey. In November, the Iraqi federal government approved a proposal to amend the budget law and allocate additional money to Kurdistan oil contract holders to start extracting oil and selling it through the Iraqi Oil Marketing Company (SOMO). The amendment met with some opposition in the Iraqi parliament. The parliament went into recess before giving it a second reading or vote.
