Well they would have to sell the land first, how long would it take to sell and who would buy it?


And if they did manage to sell the land, then they have zero assets to stand as collateral for the other side's costs in a new legal battle.


I always thought a valuation of $9 million was probably ridiculous, but it allowed ICSID to take more money from CHL via the annulment phase.


Does anyone here know how much CHL paid for the port land?

The questions are:1 what options do they have - what courts2 Will Pala fund or would the land be sufficient3 What will the likely legal costs be4 lf Pala fund, what haircut would we get

Yes a nice coincidence that, and a perfect illustration of how politics influences real world events.


I have always doubted the probity of ICSID, and the CHL 'decision' justified having those doubts.


They know CHL have limited funds so have run them down to a point where I think to fight more may not be possible due to the need for more funds to be raised first.


The next RNS will be interesting,my guess is they won;t throw in the towel, but it's hard to see how they can proceed without a further injection of capital, and apart from the possibility of PALA participating, I'm not sure where that will come from.

Unless there are financial consequences for Indonesia they will continue to flout international conventions. Until they start losing big contracts worth billions of pounds; their conduct is pretty much insulated.

The 'galling' thing is that even Indonesia thought they were going to lose.

Freeport are much bigger than CHL, and an Amwrican company, and look how they kicked them around!

If this is a reoccurring offence by the ROI they should be bought to justice my an independent international court IMO.

I think there is an element of that, the Tempo article and his statement shows that he knew there were forgeries many years before the forgeries were raised in the ICSID claim.

If no coal had been found in Indonesia then Churchill would still be in Indonesia (maybe); I think they would have passed 'Clean and Clear'.

Jack - no I think it has been PROVED over the last 2 years that roi deliberately issued licences with anomalies/ ambiguous paperwork and overlaps so that they could be revoked and given to their mates when a discovery was made.

This has happened so much it has been proven as a deliberate strategy and roi have acknowledged this on many occasions including on a national level - the unclear/unclear enquiry.

If this had gone through the law courts; Churchill would of won some if not all of the compensation; simply because of 'state responsibility' and Churchill poured millions into the ROI coffers.

I also thing the Regency did their business in a 'slap, dash' way; anything and everything was possible; that explains why 400 odd licences were revoked in the region. I believe all sorts of issues were identified.

He let us down, and not from the Court Case he shafted the original investors.Due Diligence! GUILTY OF.How much has the great DQ had all these years?....Whilst we all lost out.
