I don't like to dampen hope, even if is only faint hope, however, those who think the case can be brought to Paris need to read this below.

UNCITRAL follow something called Model Law which allows a party to go to a domestic court and try and achieve a 'set aside'. ICSID doesn't appear to have any scope for this. So, unless there is a loophole or the administrators attempt to sue the arbitrators or ICSID (probably immune), then I don't see any avenue for further action although the appointment of experts in 'contentious administration' is interesting. Would be delighted to be proved wrong:-



11.127 Under Article 53(1) of the ICSID Convention, ICSID awards ‘shall be binding on all parties and shall not be subject to any appeal or to any other remedy except those provided for in this Convention’. Article 54(1) of the ICSID Convention requires state parties to ‘recognize an award rendered pursuant to [the] Convention as binding and enforce the pecuniary obligations imposed by that award within its territories as if it were a final judgment of a court in that State’. The remedies mentioned in Article 53(1) are restricted to annulment, revision, or interpretation of an award, and they can be obtained only through ICSID. Thus only an ICSID annulment committee may annul the award. Setting aside or any other review of ICSID awards by domestic courts is not available.

The admin route is a blinder if we can get to Paris and cover costs.$10mn to ROI gets stalled in its tracks, but just need confirmation from CHL in an RNS now, if Paris is a viable option.The silver lining for me is that CC have to maintain their reputation and haven't been paid a bean so far!They want their pound if flesh l would have thought.
