I don't know if anyone reading can answer.... but would Melrose have been allowed to buy shares in the market at the recent depressed level (or current depressed level for that matter!)

sizeable comment in the Times today following the Takeover pannel's put up or shut up ruling yesterday....basically saying the 5 major shareholders were thinking of forcing and EGM to get management to cooperate with Melrose.

which way will the market take this announcement from this morning.... Four weeks to go.

Following recent representations made by the advisers to Charter, the Panel Executive has been considering the application of Rule 2.4(b) of the Code to the announcement made by Melrose, on 29 June 2011, in which it confirmed that it had made an approach that may lead to an offer for Charter.

Following discussions with both parties' advisers, the Panel Executive has ruled that, unless the Panel Executive consents otherwise, Melrose must, by 5.00 p.m. on 6 September 2011, either announce a firm intention to make an offer for Charter under Rule 2.5 of the Code or announce that it does not intend to make an offer for Charter. In the event that Melrose announces that it does not intend to make an offer for Charter, Melrose and any person(s) acting in concert with it will, except with the consent of the Panel Executive, be bound by the restrictions contained in Rule 2.8 of the Code for six months from the date of such announcement.

Big article in STimes today about major shareholders threatening to oust the chairman unless he gets his act together with Melrose.

Hopefully not where it ended up the last time an offer failed

I remember a bid of around £3.80 in the late 90s which ultimately resulted in the revelation of accounting irregularities and the share price tanked to about 35p

My share certificate was in the post together with my acceptance of the offer when the share price started to fall and by the time it came back to me the shares weren't worth selling.

There was a happy ending to the story though as the share price recovered and I sold up for about £9 a few years ago.

Those pesky arbitrageurs are still at it.... buying and selling millions of shares to make a couple of p here and there.

I suspect something will happen in the next week or so as the major shareholders bend the ears of the BoD

Todays RNS.... seems to suggest that Melrose will up their bid if given a little co-operation and encouragement from the Charter BOD.

Previously and seperately, the CHTR BOD have asked shareholders to bear with them... while they slip briefings on the qt to STimes hacks (two Sundays in a row we have had articles in that paper while not giving anything concrete to the market.)

Fingers, toes and eyes crossed Grigor. Got a sell limit order for 875p - been burned by stock takeovers once too often. Maybe a counter bid would take us up nearer the nines but that would be enough for me.
