21/6/2018 10:49 | In a better world, you'd be right, zcaprd7. After all, both sides benefit from a refund. PVCS avoid associated costs. The other side, I assume, don't really want the extra wafers. However, the other side, as always, can afford to make things difficult in arriving at an agreed refund and so carry on delaying the remaining payment they must make to PVCS. They hope to ratchet up the refund from PVCS. (The collapse in wafer prices has complicated their calculation; they may hope for a rebound in wafer prices.) "Refer back to the court" sounds great, but in reality, this means time and money. PVCS have less time than the other side. So sadly, I think the other side continues to have the whip hand. This has been the csse throughout; the arbitration decisión itself was clearly unfavourable to PVCS, favouring the larger, more important company. I wonder if the continuing collapse in wafer prices may in fact be making the negotiations to fix on monetary compensation instead of a wafer shipment more complicated: ie with a rapidly changing base figure for negotiations. all the best | cjohn | |

12/6/2018 07:47 | Hi zcaprd7, I think we're talking at cross purposes, you about 'profit' (which is a concept), me about cash...… The award was for Euro 34m, with an offset for wafers worth about Euro 12m (per YasX, which I haven't seen challenged), ie AIUI, we should receive net Euro 22m. So far we've received Euro 14.5m , we're due another Euro 9.5-10.0m (incl. interest). Happy to be corrected - we PI's are in this together ! ATB | extrader | |
