The strategy when they lost Morrisons should have been to stop everything and sell everything and give any cash to shareholders.

I am afraid that as I expectd it is being ground into nothingness by continued incompetence.

Truth, while necessary, is not sufficient. To stop it being libel you must also be able to prove it's true. And of course pay the lawyers fees whilst doing so...

This is all a bit superfluous. As I said, you can say what you like if it's true. In relation to #4420, which started all this, it's already in the public domain that there are related party transactions between MBL and companies run by Trevor Allan's brother, James. If Deepthroat is now trying to tell us something untoward is going on, why not say so rather than hints and innuendos? It's only libel if what he's saying isn't true. You've got this far; put up or shut up!

Yes. The assumption was that it was ephemeral and gossipy and was understood by the participants to be so, hence nearer conversation than written opinion. Sorry I don't have a link.

I'm certainly no legal expert but I thought slander relates to something that has been spoken and libel relates to something that has been written (or other permanent form). Was the judge taking the view that postings written on a bulletin board are more akin to a verbal chat? Seems a bit odd.

Just for information, the last time I read a judge's summing up on an advfn libel case, he concluded it was nearer to slander than libel, and should be treated as such legally. I guess this case set the precedent for other similar cases.

As slander requires a higher level of proof (you have to prove actual loss or damage not just harm to reputation) and noone in their right mind takes advfn posts seriously, it's very difficult to win a case based on bb posts.

Certainly in the cases in question (a series brought by some litigious idiot against all the people on advfn who'd said nasty things about him, supported believe it or not by legal aid) the judge threw the whole lot out.

Posting thinly veiled accusations is not whistle blowing. Taking the firm evidence to the relevant authorities is. Let's all suggest Deepthroat does that rather than devalues any real evidence by continual drip feed on this bb
If Deepthroat feels nervous of his position for some reason, perhaps we can contrive a way to help him?

It can't have been very nice being caught up in the whole Andy Moore debacle. Libel laws in this country are so biased towards the one suing for libel.

To bring us back on topic, Trevor Allan and Peter Cowgill are neither grotesquely over-remunerated nor utterly incompetent. They are also scrupulously honest in all their business dealings. Surely that is obvious to everyone?

A poster may well have the guts to whistleblow but ADVFN won't - they don't know what is true and what is not, so will tend to remove any potentially libellous statements as soon as they are challenged.

If I really wanted to know what was going on, would I rely on Delphic utterances from unknown avatars on a free bb? Let's see if it's still there in the morning. As one of the (hopefully) few people who have actually been threatened with libel action as a result of postings on this bb, I can reassure Deepthroat that he can say pretty well whatever he wants......as long as it's true.

All I'm saying is.... If it was my company, I'd probably move a lot of high value stock to a generic low value stock code, and then sell it to a family member. I'd also probably send any returns to a warehouse in Garstang, without paperwork, despite staff refusing to load the vans. If I worked for this company though, I'd probably keep a lot of evidence of all these transactions - even if they had been done under a former employees name. Just saying.

Not that anyone is expecting any good news the interims should be due. Whilst the finals were not published until August 26th, the reality is the half year ended Set 30th. The interims last year were published 9th December.
