The pharmaceutical firm noted several US states have filed announcements on agreements with Indivior in relation to its Suboxone film. "The various state settlement agreements being announced this week are administrative in nature, and simply formalize the individual state settlements which were previously agreed to in principle as part of the July 2020 criminal and civil resolution between Indivior and the states," the company said. "As such, there is no new financial or legal obligation that has arisen. The company was pleased to put those issues behind it in 2020 and remains focused on realizing its patient-focused Vision and fulfilling its compliance commitments." In mid-July, Indivior agreed to part with USD600 million to resolve fraud charges with the US Justice Department in relation to Suboxone. Obviously the team put together by Scopia assumes very strong cash flows from future revenues and a strategic team is being put in place to guide /direct/build. As a 16.9% shareholder and associating itself via these appointments and tie up via the future intended enhanced build up and direction of Indivior , Scopia obviously intends to enhance its shareholding over time. The US-based pharmaceuticals company reached a $600 million settlement with the US Department of Justice and a $50 million settlement with Reckitt Benckiser (RB.L), and its cash balance of $858 million on Dec. 31, 2020, is expected to support the payments through 2027. Meanwhile, the company's volume growth of its Sublocade injection and remaining market share of Suboxone film will generate healthy free cash flow by 2023. "We think revenue declines in recent years are likely to stabilize in 2021, and revenue should grow in 2022 and 2023," S&P said. Indivior's shares fell over 3% at the close of trading on Thursday. The drug group is trying to build sales of Sublocade to offset a steady decline by its predecessor Suboxone, which has now come off patent. Revenues for the year to end-December fell 18% to US$647mln though there was a 39% jump in the final quarter as sales of Sublocade rose 18%. Losses for the year were US$173mln with a US$14mln deficit in the final three months. During the year, Indivior settled outstanding legal cases with the US Department of Justice and former parent Reckitt Benckiser and Indivior took one-off charges of US$244mln in the 2020 numbers. Mark Crossley, chief executive, said that given the problems related to the coronavirus pandemic he was 'delighted' with the numbers. “Critically, we materially de-risked the business with resolution of the DOJ and RB matters and we took decisive strategic alignment actions which place Indivior on a clear path towards realizing the transformational potential of Sublocade. “Accelerating the growth of Sublocade remains the biggest potential driver of value creation.“ Indivior’s base case assumptions for 2021 are for net revenues to rise to US$625mln with Sublocade net revenues of between US185mln and $210mln (2020: US$130mln). | waldron |
