17/8/2024 11:17 | I agree with one part of that post. There will be minimum cash balance requirements imposed by the TSP Court in Lodt to protect the TSP creditors that are currently $800k. Certainly Ethernity would not be allowed to run down the cash and leave the creditors becalmed. New Tech have not recouped anything. They need to sell their shares to do that. Why are they not selling? I thought they were “death spiral”. They could sell down knowing they can convert again at any lower price. Money for old rope. But they are not selling. And if they hold millions of shares and Ethernity goes into administration then they are potless. All the rest is irrelevant. I track Tarana sales as you know, and I post screen shots of the stock levels at the major US sellers so we can see base units sold and deliveries of new supplies. It is fascinating. In the last seven days CTIconnect has taken delivery of 50 base units while WAVonline has sold another 60. At an average of $230 a pop that is $26k revenue from just those two. Of eight sellers. In one of 23 countries. I remain convinced that the only reason that Ethernity was ever sllowed to leave TSP was because Tarana sales were already happening. There is a financial reason why they have not exercised any warrants since 12/07/2024. So long as the share price is at 0.59p or below over the previous 20 days New Tech are guaranteed 0.40p or lower on any conversion. Therefore they have a financial incentive to sit on their hands and wait for any positive news or even a rising share price on zero news so long as the 0.40p or lower is within the 20 day window range. patt - "They don’t seem remotely worried about administration or suchlike that would kill their loan. They seem to be holding for some kind of news." New Tech have already recuperated £395k of the loan on 12/07/2024 so there is only £405k left. They are not worried about administration because that is not going to happen. The Settlement manager is still overseeing the TSP/CVA until such times as the secured creditors have been paid in full. ENET has a pool of money set aside for the secured creditors that it cannot spend on anything else. ENET cannot go into administration again. The next stage would be liquidation if they are found to be in breach of the Lod Court approved terms and conditions of TSP/CVA. This would have extremely serious consequences for the directors which could include imprisonment. Under liquidation the secured creditors (ex-employees) would be first in line then unsecured creditors which would include New Tech. Please do not try and lull investors into a false sense of security on the premise New Tech are not exercising their warrants because they have confidence in the long term prospects of the company the more so as the 'Structured Investment Deed' announced on 17/05/2024 expires in five months. Ontop of that the rules enabling more use of FWA will be announced in the next couple of weeks. This should mean ever greater Tarana sales, which is good for us, and the other broadband access solutions will be really relevant. We saw that with the recent $200k remote PON contract. I think many more coming from that direction. We got screwed because the 5G market died in its feet.
