After next week on Wednesday Churchill will be allowed to finally rise back up to last years closing price of over 50p. Then it is just the matter of Churchill winning the final main chapter before the end of June, and then just a case of how much to settle for or just go for the full settlement price.
As for todays share price I really do not care as I did not have the funds for a top up yesterday at 15p. Therefore there will be no cherry picking for me. Although I did buy some at 14p 2 weeks ago.

CHL and CON are the only 2 shares I hold.
Looks like I am having a good recovery from Oxus Gold.
At least better than some who just packed in shares altogether.

Cawkwell bought, looks like hundreds of his followers will be piling in now.
The compensation stake is worth $1.2bn (£845m), near to 500p. If Dodo offers CHL 180p -200p we should take it. Everyone wins.

People who sold, did not register what the news mean, so they sold and then had to buy back 3p-4p more expensive.

This news is significant. Indonesia has defaulted and seems they do not want to fight anymore. They are not going to throw more good money in a case that they will lose.



ROI has a substantial number of assets in UK, which will be seized to pay up.

I believe the point I referred to was in an Indonesian newspaper maybe 2 or 3 days later.
At the time we were posting on the other thread so news links could be checked there if anybody has time.

Chl draws a blank in all papers today, the times does focus on china being a huge consumer of coal. That would be good news if chl retained ownership of the highest quality coal that the ROI mine can produce.

Great post Debbie in 2359. Do you have a link to any article alluding to that prospect if it's still available please? It's very significant in my view.

I am sure Joko Widodo will not want to be in breach of a Bilateral Investment Treaty (BIT) on 20th April with a country he is visiting to expand trading links. I therefore assume they will either pay the arbitration fees or make a formal offer of settlement.

From the RNS - "Further, as Indonesia's consent to this ICSID arbitration was conveyed by treaty - in the case of Churchill, the UK BIT and in the case of Planet Mining, the Australia BIT - Indonesia's default is also a direct violation of the terms of the two BITs."

A third possibility is that ROI will simply default without comment and let the panel determine the award solely dependent on CHL's submission on merits and valuation. The only explanation I can think of for this scenario would be for 'loss of face' reasons in order to avoid formally saying 'you win, we give up'.

Or will, as Debbie has flagged up, a mutually enticing trade package be announced simultaneously with an attractive or, dare I dream, full settlement offer?

Indonesia is the fourth most populated country in the world and it's in neither country's economic interest for this dispute to continue. The UK under Osbourne has sought good trading links with China and no doubt also targets ROI given the 280m population. There are means to assist the process along with the incentive Debbie has mentioned.

The Department for International Development (DfID) budget is about £11 billion and other departments and trade agreements can make the cost of settling CHL's claim seem insignificant by comparison.

The CHL dispute is the elephant in the room for ROI and let's see if they want it removed either before or during the Presidential visit to the UK.

Even if this has to go the longer route with ROI just letting CHL have an uncontested engagement with the arbitration panel then things should move both favourably and reasonably quickly to resolution.

I was a bit slow off the mark but bought 150,000 more Churchill Mining (CHL) at around 19p on the anouncement by CHL, which came out at midday. This said that the Republic of Indonesia (ROI) has declined to put up any evidence to support its claim that CHL engaged in forging documents at the time ROI granted a licence to CHL to go for coal in Indonesia. It is reasonable to reckon that there are no other grounds to rebut CHL’s claim. Anyway, this suggests that CHL will get a favourable ruling simply by default next Wednesday 20th April.

Some will immediately remark that the coal price has collapsed and that therefore the award will be much reduced. However, the basis of computation is not on current price levels but on what obtained several years ago. This could mean an award to CHL of several hundred million pounds. Being realistic ROI, if compelled to pay, will no doubt chisel away to get a discount. Even so, CHL should end up with well over £100m net of tax in cash. This contrasts with CHL’s capitalisation of c. £25m at 18p.

Oh, and by the way, if ROI elects to duck paying, CHL can atttach its claim to any asset of ROI it encounters. Just think of all those embassy buildings and state-run aeroplanes. Even if they have been loaded with debt, CHL will still get its money.
