Clearly you are not up to date, a UK court could seize Indonesian assets in UK. They do have assets here in excess of few £billions. Not just UK, assets seizure could happen in US too.

Indonesia money could be seized too when transiting in UK.

Read this to have a better understanding of the situation

Churchill Chairman David Quinlivan said "It is strange that Indonesia has failed to pay its share of an advance payment requested by the Tribunal to cover the costs of deciding Indonesia's own application. But this is not the first time that Indonesia has been issued a default notice in this arbitration. What makes this time different is that Indonesia has not cured its default and has not offered any explanation or excuse for its failure to pay. In fact, Indonesia has not said or done anything in the arbitration since the fifth advance payment was requested two months ago. We are taking Indonesia's silence and failure to pay its share of the fifth advance payment as a sign that Indonesia may no longer wish to participate in the arbitration. It is too early to tell if this is the case, and our lawyers have written to clarify the situation. We will know by next Wednesday. However, if Indonesia does pull out, that will not stop the arbitration. Churchill remains committed to the resolution of its dispute with Indonesia through the ICSID process and will do whatever has to be done to ensure that the arbitration progresses to its natural conclusion."

Just out of casual interest I had a quick glance at the rules on enforcement of awards made by ICSID. This popped up on the website.


An award of a Tribunal is binding on all parties to the proceeding and each party must comply with it pursuant to its terms (Article 53(1) of the ICSID Convention). If a party fails to comply with the award, the other party can seek to have the pecuniary obligations recognized and enforced in the courts of any ICSID Member State as though it were a final judgment of that State’s courts (Article 54(1) of the ICSID Convention).




It therefore seems that if ROI takes no further part in the proceedings and ignores any award is made in CHL's favour, Clifford Chance could take a copy of the award down to the Royal Courts of Justice on the Strand, and enter summary judgment.

ROI's state airline, Garuda, has a fleet which includes 100 Boeing 737s and Airbuses. presumably they would be liable to be seized in any country which is signed up to ICSID or recognises English Judgments.
