     On November 5, 2007, Back Yard Burgers, Inc. (the “Company”) issued a press release announcing that it completed the previously announced merger of the Company with BBAC Merger Sub, Inc., a wholly owned subsidiary of BBAC, LLC.

     A copy of the Company’s press release is attached hereto as Exhibit 99.1 and is incorporated herein by reference.
