Presumably those paying for and providing funding for the lawyers representing Rockhopper Exploration PLC in the ICSID arbitration case have first dibs on a sizeable percentage of any compensation that MIGHT be awarded.

That in itself does not GUARANTEE success.

But remember this, the Italian Government have much deeper pockets !!!.

They can argue as successfully as they want the fact is they were still signed up to the Energy Charter Treaty until 1st Jan 2016. If they weren't there is no way King and Spalding would have taken the case or Harbour Litigation funders would have put up the cash !
