05/7/2016 09:16 | I disagree! if Illumina think there is a big problem with the PPA (which seems likely)they won't let it drag on for another year because that's another 12+ months of claims they can/will be liable for..we will see, but it seems that maybe Prem are getting the upper hand here.. let's face it there have not been many/any successful court cases recently for Illumina...I believe they bought into SEQ patents that were, well useless it seems.. all imo! | hjb1 | |

EU commision can run and run. i would be amazed if the commission beats the UK court case." If they back down it will be just before the commission reports i would think. This has always been about holding up prem for as long as possible. Its not really about patents... that's why it was a bad move getting the courts put back till summer 2017, it plays into their hands | blackss | |

Settling would make no difference? However, if damaging detail in PPA that may influence, but I don't yet see Illumina settling and if they ever did, probably the day/week before the hearing after maximum damage inflicted. | twix386 | |
04/7/2016 22:54 | I would suspect that the document which the court has ordered to be fully disclosed by Illumina is, rather like some of Mrs Clinton's e-mails, potentially toxic...for Illumina. Reading the latest instalment, I really get the impression that the "English court" remains unimpressed with the Illumina case to date. Clearly the plaintiff has the right to have their day in court, but the judge is ensuring that the case will be heard with the benefit of full and frank disclosure. If Illumina's established M.O. of serial litigation against competitors on the grounds of patent infringement is anything to go by, then what are the odds that the Pooled Patents Agreement document will contain a skeleton or two in the cupboard? With the EU (even post Brexit) looking into potential anticompetitive conduct by the claimants and the massive penalties which could be imposed if found to be in breach, then this second Front which has opened up is very likely to focus the minds of the Illumina legal beagles, rather like a strong dose of smelling salts. The prospect of a full-blown hearing next year have just become a lot less likely. No further questions M'lord. | frenchfry | |
