These two clauses in the contract were disclosed in the Judgement: 6A.1 to give his full support to the licensed products and brand and to take all reasonable steps to promote and market the same, including without limitation, spending sufficient time and care on the design of the licensed products, personally promoting the licensed products in the press and through personal appearances and making himself available for all reasonable publicity activities which Artpower wished to undertake in order to promote and enhance the licensed products; and 6A.2 to grant additional European territories to Artpower once the Licensed Products and brand were established in the UK. It will be interesting to see how these issues play out..... Anyway, it looks like a seven year agreement from about 2003 so unless they negotiate out (or there is a notice period under the contract) they are stuck with each other for another four years! The results will, I hope for all holders, set out how the company will move forward after the loss of YSL and only this will allow a share price prediction of anything near what you are saying should the news be good. | tuftymatt | |

06/11/2006 11:54 | Just a word of caution. Although Marchpole won this bit of the case, that is not really the full story. The original judgement of still stands. The bit of the case they have one is appeal against a judgement subsequent to 28th July that OB could end the license agreement and was due damages. In summary ( missing out the minor rucks over free Bentleys, shares etc!) 1. Marchpole tried to avoid paying agreed amounts to OB on cessation of the Debenhams O-Z range (150K) - LOST. 2. Marchpole tried to close down an OB outlet store in Bicester selling similar priced items to theirs - LOST. 3. OB having won 1 & 2 tried to get the license terminated for Breach. Initially Marchpole lost(Dec 2005), but now have WON on this appeal. 4. OB tried to claim compensation for lost income due to Marchpole not performing under the contract. Initially Marchpole lost but WON on this appeal. SO not quite the stunning victory claimed, but the welcome closing of this little chapter will be helpful to say the least. Marchpole has to pay the contractual amount and costs from the first trial, OB will cop the costs from this latest bit. As usual, the only winners are the lawyers. | momentos | |
06/11/2006 11:39 | peter I think the effect will be more long term than a quick 20% or anything. materially it doesn't make a huge amount of difference, but it might make people look differently at how the company is being run and see it as less of a risk. I still think it's really the YSL thing 9and some concrete figures to go with it) that needs to be completely put to bed before we see the big rises. | premierpompey2 | |

When the initial euphoria has settled, how much of a drag was this particular action. Surely there are other issues to settle yet.
