18/1/2008 14:35 | I think I won't find that, cos it didn't happen! And if you think that we wouldn't have received an RNS for such a momentous sum from Mr Morris you have to be kidding. THis is how the case last ended up in court: (if you search bailii.org you will find the first case too). BTW the main parts of the dispute were: Marchpole sued OB for continuing to sell OZ stuff - Lost. Marchpole sued OB for selling stuff in Bicester store close to diffusion range price - Lost. Marchpole tried to prevent OB terminating contract for non-payment etc - WON. (this excludes various arguments regarding Bentleys, shares etc.). Costs on that LAST case were 120K (ridiculed by judge). HOWEVER, Boateng went and flogged some diffusion stuff in 2006 with someone else, causing a further ground for Marchpole action. This is perhaps the bit settled today. "Earlier this year, Bespoke Couture Limited sold a diffusion range of garments to some of the Company's customers in breach of the Licence Agreement. The Company commenced proceedings in June 2006 against Bespoke Couture Limited claiming damages and in those proceedings Bespoke Couture Limited have made a Counterclaim in which it alleges that it has new grounds to terminate the Licence Agreement. The Company has been advised that Bespoke Couture Limited has no prospect of success and that it will be awarded substantial damages against Bespoke Couture Limited." | momentos | |

18/1/2008 12:07 | There appear to be several elements to this announcement, and it IS good news that the issue is now completely closed out. 1. It looks like they probably went to some kind of arbitration. 2. Boateng has recently expanded with a new premises in Saville Row. Perhaps some deal has been done to ensure this (predominantly ready to wear I think) store does not cause further arguments! 3. Marchpole had pre-emptive rights for other territories which may have been ceded. 4. License was initially 7 years from Jan 2003. Presumably previously expiring end 2009. It appears there is at least 1 extra year. 5. Not sure what Boateng gets out of this deal. He certainly (AFAIK) did't owe them 1.2m, so there is, perhaps, a bit of untold stuff here. It definitely sounds a little "too good to be true". SO Boateng has extended by a year for ZERO contractual return??? I doubt it! More likely that, rather than lump sum contractual payments, there is now an agreed license fee percentage. | momentos | |
